I am wondering what everyone (in which snow applies to) puts in their rental lease agreement in order to protect them from lawsuits/ issues with snow/ ice removal. I will be renting out my in-law apartment and I plan to be shoveling and snow blowing the best I can but I also have a full time job and there is no controlling the weather. Is there anything you would suggest I include in the lease to cover me for when I am at work or unable to care for the removal of the snow and ice at that time? Or even if there is a way I should write that they are responsible for the removal of snow and ice in their areas (walkway to their entrance and their parking spot)? I would love to read any and all ideas, suggestions or experiences you are willing o share. Thank you in advance. --50.79.xxx.xx |

My current wording:
"...While we instruct our snow service to also clear your sidewalk and steps, if you need to utilize them prior to our service clearing them it is your responsibility to clear enough that you may walk on them safely."
I might add something to also include if the sidewalks re-ice it is also your responsibility to ensure you are able to walk on them safely.
I leave salt or a sand/salt mix at every property and tenants have access to utilize. Only once did I have one who would literally empty the bag of salt EVERY STORM - after my guys cleared it. She's one of the reasons I switched to salt and sand mix at times. --73.167.xxx.xx |

Change as necessary to meet your city or rules:
SNOW AND ICE REMOVAL
Snow/ice removal areas include the driveway, sidewalks, garbage carts and all step areas. The single most important reason for snow/ice removal is for the SAFETY OF ALL. Persons assigned to remove snow/ice are liable for fines and City of Milwaukee fees due to nonperformance of snow and ice removal. Guidelines are as follows:
1. Thorough, timely removal for SAFETY first, the City requires removal within 24 hours of snowfall, safety may dictate otherwise.
2. Apply salt to concrete walkways to prevent slips/falls; apply kitty litter to wood walkways.
3. Snow/ice removal is necessary around refuse cans to allow sanitation personnel access to them.
4. Do NOT shovel snow onto the top of any bushes.

When we had tenants renting the unit below us, it was their responsibility to shovel the small sidewalk and front steps. We were to do the driveway and garbage cans. They would rarely do it and hubby ended up doing it because he wanted to make it safe for all in the neighborhood. Then they NEVER did it.
We lost our snow removal guy for two years and we did it, but didn't charge for it. This past lease we raised the rent $10 and got complaints..."I am a good tenant..." I promptly responded with that we set out alarm for 5am so we could remove snow before leaving for work. Sheesh!
Worried that if you say you will do it sometimes, Josh, that your tenants may wait, and wait and wait, to see if you come to do it, hoping you will do it before they have to go out and do it. The above examples are why we don't do it anymore. And this year, our snow removal guy is back! I give him a $100 giftcard for Xmas if snow removal is one of the things he does for us, plus I pay him each time he does it of course! --186.233.xxx.xx |

For my triplex, my lease says "Tenant is responsible for snow removal of own porch, stoop, sidewalk, and path to car." Like Prez, I also place a snow shovel outside each apartment.
I always shovel their areas anyway usually before they get to it. But the lease wording hopefully will deflect liability away from me in case of an accident. If not, I have liability insurance plus an umbrella. --67.143.xxx.xxx |

Our next local landlord meeting is this Thursday by zoom at 8am. I believe we are continuing our work on lease clauses for the 2 hour meeting. Our single family house lease states that one of the tenant's obligations is "To keep the driveway and sidewalk of the leased premises reasonably free of accumulations of ice and snow (salt ruins concrete surfaces, only non-salt melting substances may be used on concrete surfaces)". --99.165.xx.xxx |

I am happy that I have not shoveled snow from a driveway or walkway for 40 years! I have had to clear snow from my rental car a few times, while visiting back East. That is brutal when you don't have proper cold weather gear! When I lived in New England I had warm clothing!
