Hmmm.

Wonder how this would play out on average.

SFH with non-paying tenants.

Utilities are in Landlord's name. (dumb)

Anyways, landlord attempts to "repair" the leaking water supply pipe under house...but instead accidentally breaks it...creating water leak. Calls city to shut off water due to water leak. Makes sure that city workers witness the water leak under house.

Landlord doesn't fix.

Tenant calls codes dept.

Codes says fix it or be fined.

Landlord doesn't fix, letting codes dept know that he can't afford to hire a plumber AND make his mortgage payment.

Tenant moves out.

Landlord gets fine. (cheaper than a non-paying tenant running up LL paid utilities) --70.92.xxx.xxx

Eventually there is going to be a constitutional challenge where there is going to be a class suit where enough is enough that a free for all can not go on forever. Suppose they told the grocery stores a free for all then a week later the grocery store would close down then the workers would be out of job. They would treat any other business in that manner. When they had the emergency fund people were receiving $2,000 Cdn. per month for food and housing where you can be sure the homeowners were paying utilities and mortgage payments then the tenants were buying new vehicles and big screen tvs. Now as more people are working from home fashion is no longer a priority where people are wearing sweat pants as they can wear around house where many of stores in the malls are having a difficult time including the large stores which are unable to pay rent. In the future some of malls may close down. Now UI is lot easier where people will stay on UI for as long as possible as there no incentive to show for work. it could play out very poorly depending on who hears the case AND where you are. in reality MOST tenants are not vexatious and not smart enough to know what you just did (a self help eviction) and have no money to file suit, but in san francisco or LA they can get all kinds of free help to bludgeon you into submission AND take your money as damages. if you are set on that plan you can simply sit in on some small claims cases or even superior court and see how the judges treat the various parties --75.80.xx.xx

I once bought a house at the foreclosure sale only to find daughter squatter moved in. I went to the county utilities department to make sure I was not responsible for the bill. Utilities said the meter was locked but they turned it back on, the utilities girl said they could remove the meter & I said that was a good idea. So far you have heard all the good news........

I will bring you the worse case scenario:

So code enforcement tells your tenants that they can't live there - they move out and sue you for the cost of the move that they had incurred including the new deposit moving truck and damage to their priceless furniture. That cost could be $3,000 plus both your and their legal fees.

Code enforcement is able to tell them to move because they pulled your Certificate of occupancy. They tell you that because you lost the CO you are no longer grandfathered in and you now have to bring the building up to the current code. Depending on how old your home is, the cost of this might be four or five figures.

Because of the water leak - you also get the sewer bill that is based off of water usage. You get a big old surprise 30 days after the mishap on water that doesn't get treated at the sewer plant. You get a plump four figure sewer along with a water bill that will scare you. --24.101.xxx.xx

Actual situation back in 1997. Landlord finds a Bank Owned Property they had taken back in a foreclosure. Bank not required by law to keep up property or make any repairs. City not able to fine Bank/Owner. Tenants revolt and refuse to pay rent. City and County issue Bank/Owner dozens of violations, knowing Bank will "not fix anything".

Robert an investor/contractor makes a deal with City and County if he buys the property, multi-unit, he will have 90 days to begin repairs before the city/county will take action against him or the property.

Robert J in CA buys the building, meets with tenants and formulates a "plan". Next day City and County hit new owner with dozens of old violations and orders the property put in compliance within 10 days.

Robert now has to think outside the box. City of Los Angeles requires landlords to pay tenants of each unit $7,000 to $9,000 in relocation fee's. Then once the unit is restored, landlord has to offer old tenant their unit back at the same old "rental rate".

Robert having been pushed around by the City/County and as a licensed contractor, knows the games government plays on deep pocket landlords -- Does nothing except repair leaks in water pipes.

City comes back to inspects the property seeing Robert hasn't complied with over 30 violations and "RED TAGS" the property. The property is not Fit to live in. Tenants can no longer sleep overnight or stay in their unit, they have to move!

Robert sends tenants notices, "Remove all of your property" before the building is going to be knocked down. Tenants move without landlord paying them relocation fee's.

Robert erects a chain link fence around the lot and hires Junk Yard Dogs to keep "people" from climbing the fence.

Robert has just saved himself around $50,000 in eviction costs and lost rent. Robert also saved himself over $100,000 in relocations fee's. Robert didn't have to hire contractor to "Rush to Comply", saving $25,000 in extra repair costs.

Building left empty, City takes Robert to Court, special hearing. Robert will not play the game with a City appointed administrator as judge, case moved to real court. Judge see's purchase agreement from bank with document showing "everyone" know of the extensive renovations needed to put the property back into proper service. Judge see's agreement, Robert will be given 90 days to "begin" substantial repairs. Judge then sees the City/County bully Robert, demanding completion within 10 days. Bank owned property for over a year and no one made a "government insured lender make any repairs but hold a private investor to a different standard.

Jude dismisses case against Robert. Robert goes to the old tenants and offers them a "cash fee", if they agree they are happy with their new rental and don't want to move back to the property. Average tenant/unit only wanted $500 for their signature.

Robert then fixes up the property and rents it out. Then the City and County tell the IRS there is something fishy going on and I'm audited. Then I play song and dance with the IRS.

With the City/County I was a licensed contractor, investor, owner and property manager -- knew what I was getting myself into.

With the IRS, I had taken accounting in school with an Econ and Business Major....dealing with the IRS was fun because the auditors were as Dumb as a Rocks... --47.155.xx.xxx

When landlord attempts to repair leaking water supply pipe HE DOES NOT ACCIDENTALLY BREAK IT. Instead, the old, rotten pipe disintegrated on its own.

If he accidentally broke it, they might find him at fault somehow. If it disintegrated ON ITS OWN, maybe that is wear and tear.

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

Offhand, since the laws say that "(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32 , under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are ..." that any T that is between 17 and 45 are soldiers and are illegally being quartered for free in private property. --45.155.xx.xxx
