State Specific Question About: NEW HAMPSHIRE (NH)

Hello everyone,

This is a question specific to New Hampshire residents/ landlords or people familiar with the rental/ landlord laws. Can anyone suggest a good attorney of some sort that I could have write up my lease agreement to ensure I protect myself the best I can? Also if you would be willing to share how much you paid for your attorney to write up your lease/ rental agreement with me, I would appreciate it greatly. Any and all information you give me is beyond appreciated as I am a soon to be first time Landlord. --73.47.xxx.xx

I paid my attorney $800 to review and revise my lease about 25 years ago. Of course it's changed alot since then and will change again from the insights given from the landlords here.

Do you have a local real estate group you could join that has an attorney in the membership? That's what I did when I first became a landlord and the atty that helped with my lease was who I hired. I suggest that because a local group atty would know laws specific to your state.

First time, I cobbled together lease clauses from a bunch of leases and then had an attorney review it. It was ok. Then I joined a local landlord group and an attorney was on the board. I heard all the stories and hired him to write my lease. It is lengthy and can’t remember but I think between 1-1,5000. I have 2 multis so it made sense financially. Over the years with an issue, I call him, get advice, pay for the phone call and then address the issue in writing quoting lease clauses and offering options to correct or leave prior to eviction. I have only had to hire him to evict once. With only 1 unit you could buy Brad’s lease from this website. Also try google and some of the bigger complexes or student housing at universities that post their leases online. I think on top of the lease being good, I take the time to go over every lease clause in person or through zoom so that the tenant has a full understanding of the lease. Josh...I would advise against it. Often lawyer leases are written in a legal language that will protect you from lawsuits, but will not necessarily protect you from failing to anticipate all possible scenarios.

For example, a lease that is approved by a lawyer may say that the tenant must leave by the last day of the lease period. A better lease provision covers in advance what happens if not followed. In this case, a better lease provision would be if Tenant fails to vacate by the last day of the lease period, the rental rate will increase by 150%.

If this is your first rental, I would highly advise you to get the lease for sale on this website and a copy of Brads lease. Money well spent. --70.169.xx.xxx

I would strongly suggest joining the local LL group for your state.........the dues are well worth it. Once you get it ask other what special clauses you should add. The answers are based on THOUSANDS of years of experience. Don't want to do that as it requires too much work?

You have a few regular posters from NH and they tend to give you the straight truth.......I didn't say you will always like it but you get honesty. So go ahead and offer them a few hundred for a copy of there custom lease.

Both approaches should get you a solid lease. Learn that lease and be able to teach what your expectations are on day one. --24.101.xxx.xx

Josh,

Lawyers and realtors do not know how to MANAGE property and renters. And no reason for a lawyer to write up a lease from scratch at $300 per hour.

My catchphrase is "My lease is clear:"

42 years of experience over many properties on 30 pages, dealing with people, property, and courts. Each time a problem pops up, or I am surprised by something, or I learn from a court hearing, I add a clause to my lease to protect my business and hopefully keep that issue from happening again.

My judge says if it's not in the lease he cannot hold the res accountable for it.

No surprises and set expectations in writing.

I keep all the govt required forms and inpsection all stapled into one packet.

Paper is cheap. Leaving something out can cost THOUSAND$$$. RUN from people who brag their lease is only 4 pages.
