Just thought I'd share my experience.

Short version:

My tenant's income is Social Security retirement.

No reduction in income - or any change in his life whatsoever due to the Virus.

Judge says I have to apply on his behalf for rent assistance through a state program that says clearly to qualify, your inability to pay rent is due to covid. (Eye roll)

Continued until Jan 5. And the judge made a point to say how the court is being so generous to hear the cases that soon (instead of sometime in March) - to "avoid unnecessary delay".

So, instead of two months (already) unpaid rent - it will be three or four.

BIG sigh......

I can't help with this one, but consider revamping your screening criteria to include only tenants with garnisheable income, and only consider jobs that are better than entry-level "McJobs" they will quit the minute a garnishment arrives. --107.216.xxx.xxx

Great idea, get to know your judges. I was floored when I went to traffic court after getting a ticket for an accident I wasn't even at the scene. I watched person and person get excused with a slap on the wrist for a bonifide disregard for the laws they had broken.

From what many are mentioning here, the same is happening in landlord/tenant court. One of the attys we used way back told me "if you take this to court, the judge will likely do...." because he had experiences with them in court. --186.233.xxx.xx

My tenant violate serious terms of the lease. I'm allowed to evict for that reason, never mine they are 5 months behind in their rent.

So I supposed to have entered a "Default Judgement" because the tenant didn't answer the summons or show up in court.

Instead the Court demanded the tenant show up in court and "Come up with an excuse" within 5 days, or the eviction will be granted. Tenant showed up and said, "I was too busy to open my mail and didn't know I was being evicted". Judge said that reason was good enough so he scheduled a trail in 30 or 60 days. We haven't gotten the ruling yet... instead of having the trial that day. And you think you have problems. --47.155.xx.xxx

He would have NEVER, EVER been able to qualify. He and his lady came with the house a few years back and have been decent enough tenants. Until she (the responsible one) died.

I hated going to court... because it meant I was evicting. But I did enjoy hearing the other cases. I always wanted to go and just watch. Now you can't. Everything is done over telephone or video. If they can't agree via this means, then they set a court date in person.

Agree that a lot judges are making up their own rules. Just remember, they get elected too... --174.221.xxx.xx

Today's case was just about as short as they can ever get.....about eight minutes.

After getting sworn in I handed my paperwork packet to the judge. The judge said that my resident had called in about 20 minutes earlier reporting that they had been exposed to C-19. The judge advised the resident of the right to appeal. They told the judge over the phone that they are doing everything in their power but hours were cut at work.

In my packet was the email from the HUD housing counselor showing that they did not qualify for CARES Act and that the tenant didn't return the housing assistance grant paperwork that our county also has.

I didn't need let the judge know about that email in the stack of paperwork as I got the judgement and possession granted in about 3 minutes time.

Where I hope the resident does not elect to appeal the case - if they do, I will request the District justice court notes.........so the county judge can make the call if perjury occurred at the lower level. --24.101.xxx.xx

DJ, did you point out to the judge that they did not loose income because he is on SS?

Did you point out to him that the program is for people not able to pay rent due to COVID and so that does not apply here?

Do judges not understand the laws? I would have asked him that.

That frustrates me and it is not even my situation.
