Does anyone have any experience and/or knowledge dealing with a problem tenant who may have dementia? What are landlord rights in CA on this matter? We have only 2 rental units on our property, and we cannot afford to pay to relocate this tenant. she sued us last year, settled via mediation, got a BUNCH of $ but refused to consider moving, and is now violating settlement agreement. Tenant making false statements & allegations. Our property manager quit, and we have not been able to find a replacement who is willing to manage a property with a problem tenant. We are both on social security, my husband had a stroke in 2018, so we can no longer afford to live in the S.F. area, but cannot even sell and move to a more affordable area. why can't you sell? Sales are booming almost everywhere.

Dementia is not a term to toss about. Why do you think this? If she does, contact whatever the adult protective services is in your area as she should not be alone. If you are tossing about "dementia" based on nothing but someone older being difficult, shame on you.

I know nothing about CA, mediation or settlement agreements. We don't do that "stuff" here. Why not go back to the mediation folks to have them enforce the agreement? Curious why an agreement (if I understand this I am flabbergasted) GAVE her money but she still got to stay on the property. --72.70.xxx.xxx

If your resident has dementia he is protected under the ADA of 1991.

You need to seek legal council - especially since you have been sued once already. You can argue and say you can't afford it - and you will learn what amount you will be able to afford after getting sued again --24.101.xxx.xx

I'm a long time real estate investor here in California. I have tried to help many of my friends who have a rental or two, who refuse to treat their rentals as a business!

When your car breaks down you call the AAA and have it towed to your mechanic. Then you get an estimate and have it fixed.

When you are running a 102 degree temperature, you call your doctor or go to Urgent Care for help.

When your tenant isn't following the "rules" and is causing your family some financial "pain", you consult with a "Real Estate Attorney" who specializes in your area and does plenty of evictions. Not a family practice attorney, not a divorce attorney, not a patent attorney -- but a Real Estate Attorney.

Yes, you ask for an estimate or his fee's and work out the best resolution.

Think about this. Tenant causing you a world of hurt. Your property is worth so much over there in SF. What is the legal cost going to be? $5,000? $10,000? or even $20,000? Doesn't matter because you want the tenant out, long gone and then sell....

Or you can consult with a broker and see if you can sell the property with a bad tenant inside? --47.155.xx.xxx

San Francisco is like NO OTHER place on the planet for tenant rights. You have my sympathies. I considered a property there and when I learned of the local practices RAN like hell. --75.80.xx.xx
