A tenant applicant has a 10 year old felony conviction for "access device fraud accessory" he got probation; type of credit card fraud where he did not do the fraud but was with people while they were doing it. No arrests/ convictions since. Would you rent to this person if all the other background checks are negative and has the income requirement?

Here in California, unless there is a blood trail following the applicants foot steps into the rental, you must rent to those with low level crimes...Although, if it was a crime that put me or my tenants in jeopardy, then I would reject them for "safety" concerns. --47.155.xx.xxx

THANK ALL OF YOU FOR YOUR QUICK AND HELPFUL INPUT. Since I signed up on this site just a couple months ago, I have submitted a few questions. I am always amazed at the thoughtful and helpful responses. My business and life partner died over 5 years ago. It is hard doing this business alone. One of the things I miss is not having someone to provide input to decisions when faced with unusual situations.This forum has exceeded my expectations. He has very bad judgement about choosing his friends. That might not have changed.

I don't take felons, but at the very least find out from his current and prior landlords whether or not there have been problems with his friends and associates and check with the police to see if there have been disturbance calls to his address. --76.178.xx.xx

Yes I would. I currently have a 3-year tenant who served prison time for "assault on a police officer"...but it was 18 years prior to when I rented to him. He was honest and disclosed it before he even took an application form. He hasn't been the greatest tenant, but good enough that I've kept him. --99.92.xxx.xxx

I won't take people with "anger" crimes against people or property - too many people don't really outgrow anger issues. It would have to be a really old crime, 10+ years at least with NOTHING else. AND a good report from old landlords: no kicked in doors, punched walls, that sort of thing. NOPE.

I won't take people who have been evicted, now that I know the process and that they could have left any day before court without a hassle. Life is too short for that stress. --50.82.xxx.xxx

I had someone with a Petit Theft charge ( and it was much more recent than your 10 years). I rented to them and they were not very good tenants, but they always paid on time. They served their purpose since it was November and I needed to get someone in there. --72.188.xxx.xxx

I like to see a minimum of seven years' quiet, good behavior.

The hard part is figuring out whether the resulting seven years' good behavior was because they were locked away in prison somewhere for 6.5 of them and couldn't get into mischief. ;)

There are different grades of felonies, and I consider not only my goals as an investor but also my and my contractor's personal safety. For that reason, I will not rent to convicted violent felons regardless of how much time has passed. It's not in my scope of talent or comfort zone to be involved with a person of that temperament in that manner, nor to put others in harm's way.

Regarding drug charges I want the person squeaky clean for 3+ years. If they were manufacturing/distributing, 5+ years clean.

The years of "clean" behavior start counting after their sentence is successfully completed. No sense counting time while they are under lock and key and constant, direct supervision.

I agree that once a person has paid their dues to society, there should be grace. However, sitting in prison isn't paying any dues to anyone or society at large. Once you're a free person again, then you become a productive citizen can pay you debt to society for the cost and burden of housing, clothing, and feeding you. That's when we learn if the lesson "took" or not. That's why I think we need to reform the prison system to focus more on reintigration of people into society. The halfway house is a special land lording situation that is monitored carefully by trained professionals. I think we need to look more into those kinds of arrangements so a person has the chance to earn back the trust of their fellow man. --107.216.xxx.xxx
