I have been alerted that the tenant most likely has created a grow room out of one of the bedrooms in the rental house I manage. There is a blue light on 24 Hrs 7 days a week. I pay for water. I am upset over safety and property damage. And in California, Newson says tenants cannot be asked to leave, if I am reading the mandates correctly.

This is a safety and damage issue. Any ideas?

I believe that CA law allows all adults, not just Medical MJ cardholders, to grow up to six plants inside their home and to harvest from those six plants.

I am not sure about the limits on Caregivers and grow co-ops. I think they might be allowed to grow the six times however many "dependents" they have. That is, a caregiver for three Med MJ cardholders can grow 18 plants.

What are the safety issues you are concerned about? What are the property damage issues you are concerned about?

I don't think you have a leg to stand on.

After California legalized Marijuana, I added a clause to my Rental Agreement that forbids smoking of all kinds including Medical Marijuana and forbids growing of Marijuana even if it is legal to do so. Tenants are made aware of the no MJ rule.

Time for a visit to your property to see what's going on. It could just be a huge fish tank. We used glow lights in our 50 gallon tank that gave off a blue hue. --72.199.xx.xxx

From what limited knowledge I have on growing the stuff, is the moisture created in a grow room promotes mold and other health issues. This can be tested.

If growing inside the house poses "Health and Safety" concerns, you can evict in CA for this...

I would begin immediately eviction because of property damage. The amount of damage to the structure of the property can be substantial due to the high humidity levels. Thank you so much for your perspectives and advice. Here in California we cannot evict anyone due to Gov. Gavin Newsom's mandates,, but actually I like the tenants a lot.

My worry is the mold and/mildew damage to walls and floor, and the possibility that they have rigged the electrical and it starts a fire.

My son who lived in Humboldt County saw many damaged houses due to jerry-rigged grow operations.

We plan to do a walk through and assess if the certain room looks like it is being damaged.

I really appreciate your ideas and perspectives. Thanks again.

If you like them and want to keep them, then tell them they can't grow in the house, but you can buy a metal shed and install electrical in there. Offer to set that up for an outdoor grow room and charge shed rental.

Oh, you can definitely evict for lease violations; you do have the upper hand. However, I like LOTF’s suggestion of at least a shed since you like them. Write up a lease addendum to get any new terms in writing.

Personally I would never allow a grow at my rental, even if they were the best tenant in the world and I wanted them to stay. With drugs come problems, legal drugs have their own set of problems. With a grow you have to worry about fires from the grow lights, crime and violence from theft of the product, etc., etc.. I wouldn’t want to deal with any of it, I don’t need a call from the police letting me know that there has been a shooting at my rental as a result of some clown going to steal the pot right before harvest. --173.48.xxx.xxx
