When AAA mailed me the renewal forms for insurance on my rental house, they also notified me of two exclusions. I am wondering whether I should be concerned by these changes. I am also curious whether most other insurance companies also have these exclusions or whether AAA is an outlier.

The exclusions are:

1. Personal Liability. Excludes multiple damages - i.e. the portion over and above the original (base) award amount. For example, if the landlord violates an ordinance during an eviction process, the damage award could be multiplied over the base damage award. AAA would not be responsible for the multiplied damage portion.

2. Claims Expenses. AAA will pay for legal defense expenses but will not pay for plaintiff's attorney fees taxed against any insured, which could include filing fees, appearance fees, motion fees, and court reporter fees.

If each party in a lawsuit pays their own legal fees, #2 above would not be an issue. If courts sometimes make the landlord pay for the legal fees of both sides, there seems to be some exposure. --73.189.xxx.x

1. Almost all insurance policies exclude "punitive" or "exemplary" damages, which are awarded to punish the defendant for some wrongdoing. I think the exclusion of "multiple damages" is just another example of this exclusion of punishment for wrongdoing by the defendant.

2. I am puzzled by your use of the terms "fees" and "costs." We normally refer to "attorneys' fees" and "costs." "Costs" include things such as filing FEES, court reporter FEES, etc. I am not sure, but the exclusion of the other side's attorneys' fees might be an exclusion of another punishment-type award, when the other side's attorneys' fees are awarded as a punishment for improper litigation tactics.

Those seem like reasonable exclusions to me. Could ask for a policy from a new company and see if they have the same exclusions in them. --99.92.xxx.xxx
