How do you go about finding a qualified intermediary. Should that be a banking institution? Do you have to have documents at the time of settlement and have the profit transferred immediately. If so, where do I get the forms?

I found an intermediary through my attorney's office. Yes, you must set this up prior to settlement, and if you already have a sales contract, that will need to be re-done to designate the intermediary as the one who receives the funds from the sale. You get the paperwork from your intermediary. I think you can also find them online by Googling 'Starker Exchange". --67.172.xxx.xxx

When I was going to do a number of 1031 exchanges, I wasn't shy and called up:

a) My apartment association

b) My real estate attorney

c) My real estate agents and brokers

d) Other investors

And from various seminars and classes found a company called IPX 1031 Exchange with $100,000,000 insurance per transaction. I got their insurance policy and called up to confirm it was current, active and paid in full.

During that period a number of other intermediary companies mis-used funds and left the investor high and dry with no money, but they still have to pay the taxes on the profit from the sale of the relinquished property.

Lawson, you can sell the property AS IS so the buyer bears the responsibility and the expense of repair costs after closing. Depending on the condition of your property, it may limit your buyer pool due to the financing type the buyer is using for the purchase. --68.104.xxx.xxx
