Dear Landlords, I have a deadbeat tenant who is expecting a lawsuit settlement for some accident he was in. He told me it was projected about $500K. I am in the process of eviction, as he told me he will not move without a formal eviction process. Wondering if I can attach a judgement against his settlement when the time comes. --70.168.x.xxx

I would expect an attorney would say to get the judgement and worry later about "what he's gonna get.

It could be a year, or 2...or more before he gets anything and that's not allowing for 30 to 50% off and that's AFTER the costs of litigation. --174.225.xxx.xx

"I am expecting to get a settlement..." ranks right up there with "I'm expecting a big tax refund this year" as far as excuses used to throw easily distracted land lords off the scent.

Just proceed with eviction and then go after him to collect. If/when he gets paid, you can sniff out his bank account and get paid.

My guess is there is no settlement. Seriously, who tells a land lord they're getting a half million $$$ coming their way and then stiffs them on the rent? They have companies that will loan money against that, which he could apply for right now and get you paid, IF there was half a million truly knocking at his door.

Assuming his story is even semi-true about the injury, likely a lawyer said they think they could possible get a settlement for $X but that cow hasn't been milked yet and could die before it gets into the barn. --107.216.xxx.xxx

Plenty, lawyers are not allowed to give clients advances against their cases (except for legitimate costs of the litigation). Sometimes it may happen, but it is completely improper. Lawyers passed this law so they can cite it as a reason why the lawyer is not going to advance any $$.

There are companies that will lend the client money against the future settlement, but that is a complicated process and VERY expensive.

half the low income tenants out there have told me they have a huge settlement coming in,i think they are trying to impress a landlord who they see as capable of handling money,what they dont understand is i and most landlords are not impressed by settlement money but would be impressed by earned money but they never have that --72.231.xxx.xxx

Get a judgement, You might not be able to attach the settlement directly, but you can get money out of his bank accounts. He has to put that money somewhere.

That is, if he ever gets a settlement. If he does win his case, it might still be many years as the judgement is appealed. If he is up and walking around, I seriously doubt he has any million dollar settlement coming to him. I'm guessing that no financial adviser stole that from his accounts so he has some sort of minor employment or injury beef. Or some sort of false claim. --76.178.xx.xx
