It was the best of plans..... How could I possibly have seen this coming?

After Triplexer escapes freeloading Moratorium tenant, removes garbage and renovates damages.... he limps forward to find new tenant for apartment. At this point already backowing property taxes.

Extensive screening finally settled on a senior with SSI income, whose daughter handles his finances. And I'm talking about the best looking of at least 30 applicants. Most of them looked pretty bad. Anyway I did not want to be stuck harboring a nopay squatter again.

The new tenant also agreed to direct deposit of his payments. Daughter set them up, sent me screen prints from his bank showing it was done, all set to go. First rent payment set to go on October 4th, as he gets his SSI check on the 3rd. Every month on the 4th, automatic rent, Federal income. All looks well, right?

Until the bank didn't pay.

Oh they said the wire transfer was 'in process'. But now when I call, they refuse to say anything to me because "You're not an account holder".

Meanwhile, the renter's daughter is responding readily, says she called and talked to them, and all is set to go. Doesn't know what's taking so long.

Okay, so now its been 9 days. 9 DAYS! Need I point out that PayPal can do a wire transfer in about 4 minutes. I called today, and again was told "We can't disclose anything unless you are the account holder. Buh-bye *click*"

Is the tenant's daughter lying about rent?

I'm now stuck with a new nonpaying tenant I can't evict, whose Federally protected income I couldn't touch anyway.

Not sure if I should tell daughter to cancel direct deposit, and just pay rent outright- because he doesn't have car, and can't even get to the bank.

No one will confirm whether rent will be paid or not, if ever.

I don't know about laws over there but here in the peoples republic, if you take someone to court that is on welfare or social security then they don't have to pay it at all unless they start working. How nice to rent to someone whose uncollectable. --66.30.xx.xx

It is a roll of dice here where may ask tenant to provide post dated cheques then cash cheque every month to minimize problems. In the province of Ontario they will not even touch anyone with a credit score below the seven hundreds. A lot depends what happens after the election as no party wants to allow evictions before a election. Here the hearings are back logged for a year where can only make a payment plan if the tenant agrees. If the tenant defaults on payment plan then apply for a eviction. Bill 184 was passed into law where the left extremist said there was going to be mass evictions then everyone would be homeless. We are fortunate two years ago they voted in a progressive Conservative government in Ontario where there is majority which means they do not need the support of the other three wing parties to pass legislation. Vacancies have gone up where rents have dropped. No one knows when Cinderella clock strikes twelve then reality sets in. Eventually any legislation that is not constitutional will be struck down in the courts where it may have to go to the supreme federal court. Rental housing providers need to challenge this madness or let bad things happen. As a group a class action suit the cost is spread out. Banks here are difficult to deal with as five major banks in the entire country. --147.194.xxx.xx

We ALL feel your pain. Its just shocking and inconceivable this is going on.

So what can you do? Follow that lease you have. You may not be able to evict but you can file a law suite for none payment of rent.

Just prior to filing allow the daughter to pay you. This is my explanation to the daughter.

This is so and so-- unfortunately the payment has not been tendered for the ZYZ address. Tomorrow at 4:30 PM if not received I'm filing for none pay with the appropriate court. Write this up and place on the door for the man to see.

I hate doing this but I must protect the property. I know your father plans to make the payment but again I must start the process. Should all the cost including court cost be reimbursed we can still accept payment and remove the court action.

File your paperwork. Tack a copy on the door for tenant to see. Then follow up when the court has it signed by the judge -- copy that and place one on the door. The first of next month-- AMEND YOUR CASE-- follow your state law about service of amendments but amend it for the new rent due. Post on tenants door.

PRESSURE keep the pressure on. Keep in mind a person you described who their whole life has paid on time-- will not like what's happening with all the court stuff. You need to be sure to print out again and again how you hate putting it on this person PERFECT RECORD. Stress the "Lets get this cleared up". --99.103.xxx.xxx

1. Demand a check NOW, and have her cancel auto pay.

2. Demand she sign up using ClearNow so you're in control!

Nine days is a long time, but it is possible this was a screw up by the bank, or inefficiency created by dealing with someone in between you and the tenant instead of directly with the tenant. I agree with what LOTF says. --72.188.xxx.xxx

We had that happen a few months ago. The issue was that the bank changed ownership and account numbers and all kinds of things.

I provided notice of non-payment and stated that I'd be filing for eviction on Monday. Tenant went to ATM and met me at the bank with cash.

While the Social Security check can't be garnished, if there are ANY other funds, they probably can be garnished.

Meanwhile, I'd let the tenant know that it is time to sign up with Clearnow, and you need to set it up to debit from their account on the 3rd or 5th. yes, it will cost you $15 a month after the free trial, but I LOVE it.

You may also check with your own bank - you may be able to debit their account. --67.43.xxx.xxx

This doesn’t fly when you have to pay your mortgage. It shouldn’t be allowed from tenants.

I always say I’m sorry for your situation, but I need to be paid, just like my mortgage at the bank needs to be paid and on time. This is the process that happens when payment isn’t made, I will make some allowance the first time (lower late fees). But I would post as usual. --194.110.xxx.xx

Read again what still learning wrote. My money is that her response is correct. I pay bills using my bank’s bill payment service and they mail a paper check to the recipient about 10-14 days later.

My advice is to sign up with clear now. You’re making your life more difficult than it needs to be. --12.4.xxx.xxx

I used one of those online "mail the payment" services to pay my rent -- back about 20 years ago, when these services were still relatively new.

I ended up receiving a p/q notice on my door from the landlord and called the bill company. Turns out someone intercepted the check and cashed it forging my signature. I was able to get the money back and work it out with the landlord but I never used one of those services again after that experience. --72.188.xxx.xxx
