HI, my tenant is month to month. she wants to have a guest stay for almost 2 months and said she knows its against the lease for the guest staying longer than the permitted time and . offered to pay $100 more for each of those months. The guest is her boyfriend whom i have never met. Is there a law in ny that states I shouldnt accept the money? also my lease says a guest can only stay for 10 consecutive days. any advice would be appreciated. . --71.183.xx.xxx |

No matter what you do the BF will be staying there.
Since she is willing to communicate I'd ask for an app from the BF. If he checks out take the $100.
The reason for the lease clause is to limit the numbr of person sin the home and to guard against deadbeats couch surfing in your rental.

What can happen she moves out then left with a un screened problem tenant who did not pass a credit or background check then will end up evicting. Make sure he completely fills out a rental application then run a credit check where check any previous address not on rental application. Suddenly you may find a dog and what ever in the rental unit. Don't accept money as once money is accepted then you started a tenancy with someone you may not want. If he refuses to fill out a rental application then end this non sense right there. In a rental building problem tenants will effect other tenants. Suppose two people apply for a rental unit then would a credit check on both applicants no exceptions. --147.194.xxx.xx |

Get the driver ID and take the money. Have her write you a letter making the request for a long term guest. With a mtm lease you should be covered if things go south. She is offering to pay more than a 5% increase in rent so you are OK there as well, since she initiated it.
Is this a a B or C rental? Is your tenant mtm because they have been w you longer than 1 yr? Did you ask why he is coming to the area? --99.203.xx.xxx |

Yours is a common problem. I've had dozens of women tenants who let a boyfriend freeload! After the 10 day grace period is over and before the first 30 days, I'll give a rent increase notice, 10% extra per occupant. I will require a completed application. --47.155.xx.xxx |

I always appreciate the communication and that she "asked" permission as well as offered more in rent. Have him fill out an application and check it because it is more than the 10 days allowed. If he checks out ok, then ask her to let you know if he needs to extend his stay when the two months are up. --75.11.xx.xx |
