Had an interesting one that I haven't seen before where the application has a portion for the landlord to fill out. Resident is moving and gave us "intent to give 30 day notice" (they said: can't give 30 day notice cause all the rentals they have looked at don't want to wait 30 days for move in).

I got an email from them yesterday and they asked me to fill out part of the rental application...so the company they are applying for a house thru has a 7 page application package and on the last page they require "The bottom portion to be completed by the Landlord". It's all the basic questions you would ask in a previous landlord verification call but filled out already when they get the completed application package back. Then I would assume they call to verify but there are some positives to this approach, I think. The main one to me is cooperation level (I learned to look for Level of Cooperation from Jeffrey!) What are your thoughts on requiring the current or past landlord to fill out a form as part of the application package? --71.32.xx.xxx

I think it is rediculous,it is not the current landlords job to fill out anything for a tenant to get a new apt.I wouldnt fill it out. --104.229.xxx.xxx

It sounds interesting and might not be a bad idea.

However, does it put the previous LL in a liability situation if the tenant does not perform as before or is perceived as different then was written down as now it is in writing.

Also, the information still needs to be verified.

I wonder how many LL's would actually fill this out.

You could also contact this company and verify that they are not willing to wait for the tenant to give a 30 day notice.

It is required by law that the LL or tenant give a 30 day notice. How are you going to handle that part?

Would you tell a prospective tenant that you are not willing

Why doesn't the company just have the tenant to go ahead and sign the lease and pay move in money and then the tenant has 30 days to move?

Has this tenants lease expired?

Are they M2M?

I had one tenant give me one of those to fill out. It was from a PM company. I never received a call from the PM verifying that it was me so anyone could have filled that form out. Seemed like the PM trying to do the minimum amount of work at the expense of the owner's interests. --72.188.xxx.xxx

My rule is simple: I do not give a reference of any kind until we have received written notice, period. "Intention to give notice" is as worthless as a guy who intends to marry his fiance but never does, because why should he? The free nookie is just as good when he's not legally on the hook for anything. In the same way, and "intent to give notice" is nothing binding.

Here's how I would handle it:

"Dear Resident, thank you for contacting us. For us to give you a reference, we need the official minimum 30 days written notice that you will not be renewing your rental agreement. This notice must be signed and dated by all parties on the lease agreement to be effective. You may take a clear picture of the notice and email it to (fill in your email) or send it to us at (fill in PO box address). Please be advised that rent is still due for the last month of your lease on or before the 1st of the month, and we will be making appointments to show the unit to prospective renters. We'd like to minimize the interruptions to your schedule during this time, so if you will give us 2 weekday evenings and one morning or afternoon on the weekend that work best we will make every attempt to show only during those times. Thank you for your business and we look forward to hearing from you soon. Sincerely, The Management."

Tell them how your system works: don't let them make up the rules and expect you to ask "how high?" when they say jump. --107.216.xxx.xxx

I think it's a FANTASTIC idea and am embarrassed I didn't think of it first!

Many corporate apps contain an Authorization form the applicant signs to get info from the LLs but this is genius to simply include the form as part of the application.

One could say "no reply is an incomplete app".

I would have no trouble completing a SIMPLE form.

Our number one screening problem is getting info from current and past LLs. This "helps" solve that problem IF the LL has a "Level of Cooperation"!

I'll guess this LL/PM took the course by _____ (can't recall his name) who spoke at National Convention a few years ago. He has a LONG application which helps him keep residents an average of 7 years and if I recall, has only done one eviction in 30+ years.

Now, how to add this to my system...
