Is there any advantage to try to get your case to evict now rather than to wait for courts to actually open? That is , is there a line to get into? I'm guessing there will be a crush of cases when courts are finally open. --66.30.xx.xxx

I concur with Lynn[MA]. Unfortunately, currently there isn't much that a MA LL can legally do if a tenant decides to stop paying rent. If you want to evict for something other than non payment, I suggest that you discuss it with an attorney who is up-to-date with the latest MA / federal eviction regulations. I had my lawsuit duly dismissed when I tried to file last month here in CT. Courts are subject to open October 1, 2020, and we can file on October 10th. I have a tenant about 3 months behind in unpaid rent with damages to property. --70.168.x.xxx

Carol,

I don't know MA law.

I like your thinking.

I will suggest that judges tend to do what they want so each court might be different. Call yours and ask.

In MY court we filed while it was "closed". Got in line. Some LLs had hearings THE DAY it reopened.

Be aware your court may have new rules. Our courthouse is closed so we had to make an appointment to file, the metal detector guys also take our temperature and ask a bunch of questions before letting us in, plus all the new distancing barriers and procedures, like we cannot hand a paper to the clerk - it must be mailed.

My best advice: try to work out something with the res. It will be difficult to find a new place with an eviction on their public record and credit report. Move now before we file.

Also, don't assume all residents know the moratorium limits. My last 3 evictions did not mention any moratoriums.

I’m fortunate that my eviction lawyer lives across the street. Although I am an engineer by education, he tells me I would be a good attorney. I ask I’m challenging questions on a weekly basis. My lawyer said it’s best to not say anything right now. The moratorium end in 3 weeks. Anything you say or what they may think you say will be used against you in a court of law. --66.30.xx.xx
