How do you evict a holdover tenant? A tenant who has not signed the lease nor ever paid rent, but whos name is still listed on the lease as one to occupy the residence. The lesse who lived with them has since vacated the property. Lease expired years ago and it has been month to month for several years up to this point. What can be done to remove the holdover?

Same as evicting anyone at your rental. Give them a 3 or 5 day notice to quit, then go to court, file eviction papers. Follow the proper procedure. Even if they never paid and are just listed as 'occupant', if they are an adult, they have rights and must be evicted legally. Get a lawyer if necessary to do all this for you unless you are really good at doing evictions yourself. --72.199.xx.xxx

In NH you can evict the named people on the lease “ and all other occupants” (I think is the correct phrase). A set of paperwork is needed to serve each name. Joe Smith, Jane Doe and all other occupants - need 3 sets of paperwork to post and serve. Don’t know about CA. --107.77.xxx.xx

Any 'unknown' or known adults living in the house, must either be listed on the eviction papers by name, or if not known, as 'Does 1 through 10' on the paperwork. If that is not done, the inhabitants can sign a 'right to possession' form (which should have been served with the original eviction paperwork) when the law comes to do the lock out. It obligates them to be included in the lawsuit and therefore responsible for paying for any damages or unpaid rent the judge may grant the Landlord. Most 'occupants' prefer not to have an eviction on their records and probably won't sign to accept responsibility. It would be silly to add your name to a court prosecution you don't have to join. The court system in your city should have all the paperwork and instructions necessary on their website to coach you through an eviction. Check the Superior Court Website in your city for advice, but it's much better to just hire a lawyer to do this all for you. However, if you are actually the Tenant and not the Landlord, I'd advise finding a new place to live pronto. Non-payment of rent cases are usually settled in favor of the Landlord. --72.199.xx.xxx

Most of the time if the "tenant" didn't sign the lease, then you have no contract to collect rent and must evict to regain control of your unit/property.

Consult an eviction attorney, not a family attorney or sport attorney.

What I do is serve them a 3 Day Notice to Pay Rent or Quit. Then I proceed with an eviction...

I would also call your tenant that moved out and let them know since the unit/property wasn't completely vacated, you have no choice but to sue them also. It is in their best interest to speak with the person in the rental and try to get them out also. --47.155.xx.xxx

A judge here in NJ evicted someone who was not on a lease when the others moved out. He asked her where her name was on the lease. She babbled something about renting just the room and he said she needed to get out immediately. I was there to evict someone and watched this happen. Three young men in the Catholic school I attended became judges. One is a federal judge. It's something about the unfairness of treatment at that school perhaps. Maybe that explains why 6 of the 9 are Catholic. --71.104.xx.xxx

Remind the tenant who signed the lease that until their friend is out, they still owe rent and you cannot return the deposit.

If they can't get their friend out, then you evict ALL PARTIES on the lease as well as all other residents. Let the actual signer to the lease know that they will be named in the eviction as well, and it will follow them around. --67.43.xxx.xxx

James/Jose it sounds like your wife/roommate/good buddy who let you move in moved out and got even by turning off the utilities when they moved out. An eviction is a nasty mark that will be with the resident for a long time. It will impact future employment. I truly don't like ever pursuing that path as it will be hurting someone for a long time.

In Pa the governor, you can get a murder charge removed from your record. Even after the resident pays what is owed on Pa - the record of the event still stays. If you are a LL please seriously consider that.

If you are a resident - how smart is it betting against the future of databases in America?
