Hi,
I've just learned from the news about a number of groups of LL in my state (Illinois) are suing the governor challenging the eviction moratorium. The governor just extended the eviction ban another 30 days to Oct 22. He's been doing this since March. So far none of the judges dare to rule against the eviction ban. It made sense. Who would want to be a bad guy (or bad judge) to rule against the ban. I wonder why don't these LL groups go after money; sue for the money (damages) that the unconstitutional ban caused. I wonder whether other LL groups in other states succeeded in the lawsuits. Want to collaborate? I wish my local LL group initiate the lawsuit. I would join in (to get the monetary compensation). Yes I have a few tenants who are still working and decided to stop paying rent entirely because they know that they're "untouchable" during covid-19.

A church in NV sued challenging the ban on church meetings. Seemed to me to be pretty cut and dried, on the Freedom of Religion clause of the First Amendment. But they lost, because of the governor's emergency powers.
If the First Amendment cannot win, I doubt that the Landlord's Fifth Amendment right (taking property without due process) would win.
I tried to get a group of LLs to pony up some money to fight, but there was no support. Lots of talk, but no one offered any $$$.

If everyone bands together as one group then a class action suit to hold the government responsible for the economic hardship. Now is the time so the day after the election things get rolling. Tenancy advocates do believe in private sector rental housing where the pandemic is being used to expropriate private sector rental housing. Here they told the radical tenancy advocate groups brought in rent control as means to expropriate rental housing then once the government takes over rent control ends the next day. There should be compensation for the losses this caused. The government would expect the grocery store to provide free food or treat any other business in this manner. In Ontario Canada tenants were receiving $2,000 per month for food and housing where they work out a payment plan or expect to meet the sheriff after the hearing. The extreme left wing tenancy advocate said there was going to be mass evictions which did not happen. Most towns and cities rent has dropped 10 per cent where there are more vacancies as foreign students will not be here. Now the program is ending where tenants can apply UI which is going to offer the same amount. If everyone in the entire country does a class action suit then things will change. --147.194.xxx.xx |

Robert,OntarioCanada[ON], DOes Canada have a covid eviction ban like in the US?
Libi[NY], same here. The governor keeps extending it every month. The only worse state is California. They have the ban until Jan 2021. I wouldn't be surprised if it get extended further later.

There have been at least two lawsuits filed to try and overturn the federal eviction ban. Noted in the article is the fact that judges in 13 cases (state and federal) when asked to weigh in on the merits of the case have declined to stop the bans. Does anyone have any reference to a case that has been won to overturn an eviction ban? I know some have filed suit and gotten to restart evictions after a ban has expired but I can't find anything about a ban being overturned.

Two years ago they voted in a Progressive Conservative government with a majority in the province of Ontario where Doug Ford said Ontario is open for business. During the pandemic people were getting $2,000 Cdn. per month to cover for food and housing. They have lifted the ban on evictions where there are hearings are being heard where people can work on payment plans or face the sheriff. The leftist tenancy advocates had demonstrations where they wanted the city to step to stop evictions where the Landlord and Tenant act is a provincial jurisdiction. The extreme leftists said there was going to be mass evictions where everyone was going to be evicted which did not happen. Now the program has ended where people can apply can for UI to get money to cover living expenses. There is not going to be a federal election here as the federal Liberals made a deal with a leftist party to stay in power as if a non confidence motion the Liberals would have to call a election. The extreme leftist tenancy advocates do not even represent 0.01 per cent of the population where if government would withdraw funding they have to find work like everyone else. The number of people here during the pandemic is around 300 per day in Ontario where some days there are no deaths where slowing the economy is starting to open. Think of the economic damage this free for all is causing where the economic recovery is never going to happen. Rental housing providers buy goods and services locally not the third world. Some areas rents have dropped 10 per cent as vacancies rose. A majority provincial government can make decisive decisions with out consulting the other left wing parties. --147.194.xxx.xx |

They are pretty much not concerned about any constitution, bill of rights or laws as they are using a so-called pandemic to make there own rules and laws as they please.
They should be stopped and sued and not re-elected.
Unfortunately, there are a lot of people who believe all of these pseudo numbers and data being feed to them and nobody is recognizing the things that just don't add up or make since. Others just don't want to create waves and then others are truly afraid of the pandemic and are snow blind. It has been mentioned many times now about how the results are inaccurate and now they are saying that there have been to many test. The so-called experts do not know what they are doing and are really flying blind but people believe every word and don't question when they change there mind.
There are also so many other things going on right now at the same time that people are probably just trying to ignore as much as possible and hope that it all just goes away as it is very stressful.
I really wonder what the real motive is behind all of this. It just seems to odd that all of this is going on and yet the economy is moving right along, at least in house sales anyway. What goes up must come down. That is science that we know for sure. --73.120.xx.xxx |

JAC [OH], that's what I've said. No judges ruled against eviction ban so far. Why don't the LL sue for the monetary damage? It's easier to win money than to overturn the ban.
Robert,OntarioCanada [ON], thanks for the explanation. I did the math and figured that my tenant who stopped paying is making more money now when combining her hour cut wage with the UI. Yet, she didn't pay because she knew that I couldn't evict her. What a rotten person.

Unemployment insurance is going to have about the same amount of money as the previous emergency fund where the government is trying to encourage people to work. When the pandemic started tenants thought they would not get evicted if rent was not paid where at first hearings were not open. Now reality is going to take place where most prudent rental housing providers will try to work with tenants as no one wants a vacancy. We are fortunate that the left wing Liberals were voted out two years ago as the Liberals would have sided with the extreme left wing tenancy advocate groups. I have never seen where rental housing providers were vilified by extreme left wing fringe groups who never understand the reality of running a rental apartment building. Over a period of time components of a building wear out where replacement is required like a roof, boilers, water heaters, plumbing, structural repairs along with updates as new requirements. I am outraged. What will come next? Demand for free groceries, clothing and utilities? This is a train that is off the tracks and when mr. Big bucks comes up and buys my units you can be sure he will hike up the rent sky high. My tenants have always had cheap rent because I am a landlord with a heart.
