Any ideas on how to nicely "harass" deadbeat tenants? My lawsuit is pending in court, which are currently closed. I am trying to "lay on the horn" with sending bills, text follow ups, scheduling yard work and preventative maintenance to show a presence on property (I do not live close by). I would do this and have done this with great success.

Gave them a call. You know we've filled this electronically with the court so we are in line. What we would like to do is keep you in the property by coming up with a plan. (have the plan already in your head before calling). We can do half now, 25% more in 10 days and the balance of 25% by the 25th. We can waive all the late and miscellaneous fee's if we can bring a consent to the court. So half for example may be 600.00 let them know what you could do- they may counter with I can only do 450.00 or 475.00. Your answer is yes I can do that-- I'll adjust the other two payment.

I'd like to drop this off for you to sign and I'll pick up the payment. Once it's signed I'll drop or mail to court our consent. Make the consent part of your dispo case.

You have to be in control driving this. Statements like the court is going to make us work it out and it would be great to do it now rather than in front of 200 strangers....

with 63 residents we've had our share of talking to people. Once the court papers are signed and on the record the talking has much more meaning. Bring up what you've done and why-- to protect the property. Always your willingness to work it out.

Right now I have one no pay-- but the sheriff hasn't served the warrant yet. Once I see that the talking will begin. If you don't have that bargaining chip you better make one up-- like lease is coming due or lease violations you've let go or over looked. --99.103.xxx.xxx

Here is how i nicely harass tenants when needed.Keep in mind i am 6 foot,290 pounds and with an attitude that does doesnt take any gruff.I will stop at the house daily,knock on the door and ask for my rent,they say i dont have it or governor said i dont have to pay you etc.i will stop later that day or the next day multiple times,sometimes i just walk around the property,sometimes i knock and ask for my rent and ask when will you be moving.I call from my cell,they rarely answer but it puts pressure on them,many cant take it and move within 7-10 days.Ypu have to remain nice so if the cops come they have no reason to tell you to leave and dont come back or arrest you for harrassment. --104.229.xxx.xxx

All good ideas (creative), myob I really do not want to negotiate with them to stay...I have had expressions of violence on the property (domestic abuse claims by the joint holder, vulgar words towards me by the other), and damages as well (holes in walls from punching and damages floors from stomping foot). I think a restraining order would be a better idea...Lotf...funny but good one...plenty, good idea also..I just may do that. Thank you all for the creative ideas; you truly have a great group here. Turn a piece of notebook paper sideways and start with the last time rent was paid in full, start adding the damages you described with utilities agreed in the lease and the actual rent - you have a just created an account due bill for court use. Actually the -CDC- order does not apply to damage so you would visit your clerk of courts and request the case move forward for unpaid damages. --76.188.xxx.xxx

Rita, this is part of my response to Carol [MA] in her post "what to do these days". If they have caused damage or threatened violence you might try these to move them along.

Do you have an attorney helping you with these types of issues / problems? If so are they thoroughly familiar with MA LL / Tenant rules, regulations & laws? If not then you need to find new legal representation that regularly handles LL / Tenant matters in both your local district courts as well as in the MA housing court if your area has one.

You need to talk to your lawyer about using Section 19 of chapter 139 of the MGL to get rid of this tenant before they put you out of business. If they don't think that this law applies then have them pursue obtaining an injunctive relief order. Depending upon your age, your attorney could possibly pursue some sort of elder abuse angle to get this matter resolved. Since Governor FAKER & other branches of the government have made it virtually impossible to evict for non payment, you need to be more creative. --71.174.xxx.xx

Here in Los Angeles, if the landlord threatens an eviction for non-payment of rent during the pandemic, then the landlord will be fined $10,000.

I told one of my college educated tenants with a masters degree from USC, that he has the means to Purchase my apartment building, and can easily pay his monthly rent on time! No threads of eviction.

So this tenant filed a complaint against me. I then filed for binding arbitration as specified in the tenants lease -- to resolve the issues.

Now the tenant has refused to meet for binding arbitration. So I'm going to file a case in small claims court seeking my "damages", which includes rent, late fee's, legal costs and my time.

If this isn't one legal way to harass a tenant, I don't know what else I could do! --47.155.xx.xxx

Have a tenant who has been working during the moratorium and has been irresponsible about paying the rent. Just bought a white Mercedes Kompressor. Was illegally parked, so I had it towed. Rage, accusations, demands I pay the tow charges . . . Thousands owed, rent spent on sports car, lol Just the first lesson. During my first and only eviction case, after the judgement in my favor, the tenant still refused to move out and we had to wait for the Sheriff for a month. Somewhere in that month, I'd had it with her, nailed a huge FOR RENT sign on the house and laughed hysterically as people rang her bell asking to see the place. Lots of people. Last night my last no pay --PAID. They got the notice from the sheriffs office that a no rent case was filed.

So our conclusion is this: no one wants court during this time. This morning we will immediatly notify the court and the tenant we are dismissing the case. Its still on the record but dismissed. As LL's check records they can make their own decision as to why.

Our civil courts are still closed and will be for many more weeks. Some county's courts are working -- thats good. It does us no good to stomp and threaten or harass-- becasue there is no end game possible for us.

LL's are like the mice in the maze. We hope when we get to the cheeze they'll be some left.... --99.103.xxx.xxx
