Our tenant of 3 years moved about 65 miles away, I actually mailed her deposit by regular 1st class mail on the 1st. (to the address she provided me in writing)

However, she failed to tell me it was an apartment complex and she did not give me an apartment #. So, naturally it did not get to her, and I have not received it back yet. I believe it takes a full 2 weeks to get a letter back, we did have a holiday in there also. She mentioned that maybe I should put a stop payment on it (that costs me 36.00). Even on the best days, we have problems occur when things should just tick right along like a clock.

My book of learning things the hard way is getting thicker.

Looking back, I could have asked her if it was a sfh or apt.?

Sent it certified.

Made an appointment & given it to her in person.

We have 45 days in Va so I am not worried yet.

I just did a similar thing but misread a number due to tenant chicken scratch. Sent regular mail and took about 2 weeks to come back. I sent a text for an address clarification, wrong number but they also forgot to write apartment number. Put it all in a new envelope and a photocopy in my file to show mailed originally on time. Since tenant didn’t give you full address and you still have time, I would tell the tenant you are going to give it a little more time to return to you before doing stop payment. --73.17.xx.xxx

In most cases, you only have to Mail the Deposit Refund within a curtain time period, knowing it takes a couple of days to a week to get there. Here we have 21 days to "Mail" the deposit. I always send the deposit refund with a TRACKING NUMBER so I can confirm via the internet it was put in the x-tenants mailbox. I do not require a signature for proof of service.

But I do stamp on the back of the check it must be DEPOSITED and NOT CASHED into the person's "named" bank account.

I send the refund using a personal bank account set up for deposit refunds. The checking account is tied to a savings account so I can transfer the amount needed to make the check good. And not too much more so if the check is stolen and modified -- the crook won't get much more than the check amount. --47.155.xx.xxx

At the move-out inspection I give the tenant a blank envelope and have her address it to herself at wherever she will be. Then I use that envelope to send the accounting of damages and any refund that she may be entitled to.

Why?

I can't imagine that is legal. If I want to cash a check payable to me, I should be able to do so. Of course, apparently quite a few banks will no longer cash the check unless you are an account holder. --72.70.xxx.xx

You could give her two options since she was implicit in the failure. 1) she authorizes you to take the stop payment out of the refund or 2) she waits 14 days for the check to be returned and then a new one will be mailed. --64.130.xx.xxx
