Carol, in the MA State Sanitation Code, you can find that as well as a lot of other things that MA Landlords are required to do. As I'm sure you are aware in MA a LL doesn't have to actually pay for the heat they just are required to provide a working heating system that can meet the MA requirements.

Residential

MGL c. 186. § 14 Landlord of dwelling or manufactured home required to supply heat.

105 CMR 410.201 State sanitary code

Temperature requirements. Regulation requires temperatures of at least 64 degrees at night and 68 degrees during the day from September 15 to June 15. Temperatures should not exceed 78 degrees. There can be exceptions, so be sure to read the regulation for details.

Minimum heat requirements are part of what is called the state Sanitary Code. If a landlord does not respond to a tenant’s complaints about a Sanitary Code violation, the tenant may request that a code enforcement officer or the local board of health inspect the apartment. Find your local Board of Health or Inspectional Services Department to register a complaint about lack of heat in rental property.

"If your landlord does not make repairs after you have either notified her in writing or she has been ordered by the Board of Health to make repairs, you may need to consider other options, such as withholding your rent, making repairs and deducting the cost from your rent, working with other tenants to put pressure on the landlord, taking your landlord to court, or breaking your lease." --71.174.xxx.xx

you won't believe this but here in GA i just picked up50+ furnace filters 16x25's and wentt hrough the furnace parts box for glow plugs flame sensors, circuit boards thermostates and 3 amp fuses. Oh and 1 gas valve.

In this case I pay for the heat, not practical to change over to do differently to this building.

Will be turning on today. I have one demanding tenant in that

building that calls the BOH for any little thing. They CAUSE problems so they can report it, uses it as a tool to not pay rent. Trying not to give them more tools. Trying to get rid of them. --66.30.xx.xxx

Carol, Regarding the tenant calling the BOH- I have a remedy for this. I have the BOH come in and do an inspection BEFORE the tenant moves in. If anything needs to be fixed they will let you know and reinspect when it is done ( without a tenant there to hold up the repairs and play rent games).They document that there are no violations. If the tenant calls them after move in they will go out and do a new inspection. If they find violations, they order the tenant to fix and give them s a timeframe to fix it in. --68.118.xxx.xx

Here in NJ there is not a date, it is the day that the outside temperature does not go above 68 degrees during the day. Everyone in my buildings has some way to control their heat and turn it on when ready. In the one with one central heating unit, there are baseboard units as supplements in the apartments.

It's still solar minimum, no sunspots, and this is one of the signs. Early cold. It was 48 here in the morning yesterday. We are heading into Solar Maximum but it will be a lower maximum for several cycles. Prepare for colder and wetter by insulating where you can. It's kind of cumulative over time so if one cycle is cooler and that goes on, at the end of this thirty year cycle of lower maximums, the glaciers may be back. Plants and trees seem to like this. My willow tree has exploded in growth. Crops like it too. Extreme sun is only loved by desert lizards. --71.104.xx.xxx

If the building has a boiler system then installing a electronic Tekmar boiler control system where there is sensor on the outside, sensor on the boiler loop and indoor sensor in the building where can set up the outside temperature that the heat comes on. During fall and spring some days heat is not required during the day where the heat will come on when the temperature set. Over a period of the heating season a electronic boiler system will pay off then savings after that. Not only is there saving in natural gas, electricity where also less and tear on equipment. A bit more then get a control where in the future if a indirect hot water tank then the boilers can be used for hot water. Indirect hot water tanks lose less then one degree per hour along with more hot water and last many times longer then a direct fired hot water tank that is coming on to compensate for the heat loss going up the chimney which can be 7 to 12 degrees per hour. In the apartment building the outside temperature was set for 10 degrees Celsius where the inside temperature was set for 21 degrees Celsius to conform with the building code. Today the heating would go off where at night would come on. --147.194.xxx.xx
