I admit it-I have NEVER evicted for anything but non-payment. I am now being faced with evicted for unauthorized tenants.

I have seen in the court records (ours are all online) where evictions suits for having an unauthorized pet have been thrown out for not giving the tenant 30 days to correct the violation. --76.189.xxx.xxx

Eviction for lease violations require a 3 day notice. You are not required to allow them fix the issue.

There are some tenant actions that might require a 30 day notice. I don't think that unauthorized occupants is one of them. Usually a material breach of the lease allows for the 3 day. --50.5.xxx.xx

Gotta know YOUR judge. I'm hearing some CRAZY stories lately!
I suggest a 3 day, hoping they will take you seriously. If not remedied, send the 30 day on day 4 if your judge wants it, and plan to move forward.
Always: set a deadline and a consequence. Otherwise your notice is just lips flapping in the wind.

OH is a 30 day state unless a health or welfare situation evolves, drugs would be a 3day forthwith eviction. I would review your lease about the common -grandma summer vacation- which is 14 days in any 100 so grandma really gets 3 visit a year. But stacking is not good when children are involved, I would do a 3day violation notice and follow with the 30day which is what the court wants to see... --76.188.xxx.xxx

What Vee said Susan ... give the 3 day to "correct" and if not corrected, then follow it with the 30 day eviction.
Just watch "WHO" it is. Some states (and I don't know if it's Federal but I don't think it is ... but I didn't look) will allow immediate family members to stay and they cannot be evicted. If the tenant is aware/ knows this ... then you won't be able to do anything about it unless it is considered a health matter.
Years ago I asked our health dept and codes if there was an occupancy "limit" that if someone was renting a (lets say 2 bedroom) but wanted a family of 9 to live there ... and they said "nope, perfectly fine with us ... it's up to the landlord". I don't think that's true any more. --67.242.xx.xx

I'm not sure there ARE 30 day eviction papers to give to a court! Never seen any, anyways.
This is a little more complicated-the tenant allowed 2 (or maybe 3) people UNRELATED to her to move in. She has since moved out (and left all her stuff behind) as she is "afraid of the man and afraid for her child".
She's already had the cops out. They wouldn't do a thing-except tell the man he would have to allow her to retrieve her stuff.
The man has some drug convictions (I think) but he has a really common name, so I'm not sure. --76.189.xxx.xxx

We are all trying to clean up the perception of landlords. We're not a group, any longer, who tie the tenant to the tracks as the train approaches!
Always give the impression your willing to work out anything with tenants-- especially in today's atmosphere.
What does it take, required or not, to give notice to cure? Again this is for violations in the contract.
Rent none pay is pretty much regulated by the lease and gov't and that Judge we know well from this site-- you know the one mentioned as "yea gotta know your judge".
So whether it's too many people, car in yard, trash or lawns not mowed-- document you tried to work it out. --99.103.xxx.xxx

Oh you have a whole new thing now, 3day naming original tenant and -et al- as lease break with holdover unauthorized occupants, so that you can get everyone -known and unknown- out of the place, likely the green card mail will come back but if the address is correct the service will be -perfect- for court to go onward which in my area used to be 21 days - now 30, familiarize yourself with -zoom- as you will likely be the plaintiff from home. If you want a little -zoom- practice lookup REIANO for this Wednesday nite meeting I will be sharing hosting regarding the lead problems in Cleveland and using court to collect old judgements, the meeting and passwords should be on the website now, just observe your computer behavior for court familiarity - best with wired internet, wifi makes the video get shaky like old disco dance floor strobe lites... --76.188.xxx.xxx
