Tenant from roughly 5-6 years ago reaches out.

Tenant did damage. Unpaid damages of course. Wants a copy of the lease from living in a place less than a year. Resident wants exact dates and willing to pay $200. for a custody battle.

It didn't make sense but I eventually replied. If willing to make right, and pay X damages, will give copy of lease.

A day or 2 went by then resident agreed to meet at bank with amount close to get copy.

Instead I was served to appear on behalf of defendant for rape charges that apparently started to occur while renting that unit.

I did background prior to leasing. Nothing like that showed.

I really dislike being any type of witness for this guy.

I'm agitated that I have to go sit in court and wait to be called to produce a document that will help.

It states in document, I may wait daily until I am called as a witness.

NE don't get too excited. I think Covid is real and have know people who have died. This to me is about Karma. Don't leave owing me money, then ambush me with a subpoena and think it is going to turn out Ok. Thats when karma kicks in. --108.56.xxx.xx

You received a subpoena. You have to go. Just say you don't know anything about it since you did not actually live at the house. I am assuming that you don't know anything about rapes, unless that is why you made him leave. If you gave him notice to leave because he was accused of rape, then say that.

His lawyer will be smart enough to not ask you to be a character witness. The money he owes you has nothing to do with it, so unless one of the lawyers asks about it, don't bring it up.

Your tenant will be rigth there, so that is a good opportunity to serve him court papers if you are going to get a judgement for what he owes you. --76.178.xx.xx

Three issues: who handed you the subpoena? Generally (I do NOT know Ohio law), the person serving papers cannot be a party. So if it was the former tenant who handed you the paper, you might not have been served.

Does Ohio require witness fees to be offered (“tendered”) to make a subpoena effective? Without an offer of fees, the service might not have been effective.

Do you have a copy of the lease in question? Sometimes, old records are lost, or destroyed (either through disasters or as part if document retention practices). Maybe you shred all files five years after the termination of the tenancy as part of your business practices?? --98.182.xxx.xxx

Here are the sanctions in Ohio for disobeying a subpoena.

(E) Sanctions. Failure by any person without adequate excuse to obey a subpoena served upon that person may be deemed a contempt of the court from which the subpoena issued. A subpoenaed person or that person's attorney who frivolously resists discovery under this rule may be required by the court to pay the reasonable expenses, including reasonable attorney's fees, of the party seeking the discovery. The court from which a subpoena was issued may impose upon a party or attorney in breach of the duty imposed by division (C)(1) of this rule an appropriate sanction, which may include, but is not limited to, lost earnings and reasonable attorney's fees.

If you want to use an excuse, i would document you notified the court in advance (say 2 days). Long enough so it doesn't seem like last minute, but to late to create an effective work around. --108.56.xxx.xx

If he did it, there was nothing about it that would have made me play any role in it. I was encouraged to go produce the documents and await cross-examination. It was said to me he was stupid for doing it in the fashion he did because now I'm bothered and will not hesitate to say negative things if asked

The tenant got another party to serve the documents. The tenant was just there at the same time

I was told to fully cooperate so that there is absolutely no reason to appeal a later time if he is convicted --77.234.xx.xxx

Chances are it will be a zoom hearing so the coughing will be on your kleenex at home, if you evicted this person why not recapture the lease from the court that held the hearing? If you get sworn in I would mention being absent from the premises if that is the line of questioning, likely you would only have heresay testimony. --76.188.xxx.xxx
