Hello all,

I will soon begin showing a property that will be empty at the end of Sept. I am wondering if renting it from the start on a month to month lease would help at all with this new CDC moratorium.

What I read just talks about nonpayment of rent with eviction permitted for other lease violations. Would overstay possibly qualify as a violation if unpaid rent was not mentioned? Has anyone in one of the current moratorium states tried it? Is there a lease clause that might help?

My goal is to reduce turnover.

If I did MTM I would not be driving my Porsche 911. The Early Lease Termination Fee on yearly leases paid cash for my car in just one year. That one clause continues to give and give and give.

I cannot find info on LA's evictions - open or closed, but staying over, even MTM is not normally a justification for eviction during a moratorium.

Screen thoroughly, esp look for PROOF they have been workign and paying rent all along OR take Sec8 or SSI income, and rent it.

(note: we normally do not accept SSI because we cannot garnish if they owe money, BUT we're relaxing that a bit right now to get some places filled.)

Go month-to-month on leases.

That way, if they don't pay, can evict for holdover even if we can't for non-payment.

Pretty good idea. We rent mtm already and have almost from the beginning.

I think giving a 30day/full rent paying period move out notice might be the way to go in these times. You don't have to and shouldn't give a reason for wanting possession back.

Then you are evicting for possession and not rent.

Gotta know your judge. I do not picture MY eviction judge allowing HOLD OVER as a reason to evict.

I don't see the rent stoppage controlled by a monthly or yearly lease changing the court behavior - but OH was rent is due until yesterday and I sent 2 packing. However safety violations have been evicted even during the moratorium period we had while courtroom converted to zoom meeting equipment. --76.188.xxx.xxx

We had a writ issued. We weren't informed of date. Bailiff said looked vacated. But it shows no service day of move out due to neither party there.

Just informed by a lawyer that all of my month to month leases are void. That none of the 6 pages of terms apply because the lease has expired. Terms revert back to what OH laws are. For instance, I demand a 60 day notice for moving out. He says I can only require a 30 day notice according to OH laws. I have a co-signer on the lease and he says this is now longer applicable. I have thought that tenant must follow the last lease signed. I have been a landlord for 14 years. Most all of my current tenants are on mtm. I am pretty rattled by this if it is true. No though I did ask. Great suggestion-I can email it to him,

My immediate issue is: There were 3 people living in the house with each signing the lease agreeing to the entire rent amount-then they divide it up. I also have a cosigner on this lease, The company that oversees their housing and care of these special needs people. 2 out of the 3 people died over the last 2 months just informed a week ago. I want to continue to get full rent at least until November 1st. The person living there should have to give me notice to move which the lawyer said would be November 1 by OH law.

The company overseer keeps saying the 1 tenant can't afford to pay until Nov 1st even though the owner of this company is the co-signer on this expired lease. Not sure what to do. I doubt they have an estate/probate but I will ask. --72.240.xx.xxx
