Residents, husband and wife, have split. Husband moved out with the dog and the kids, leaving the wife. I am speaking with the husband on getting her out, utilities and ETF. Does anyone have a form that I can present to the Husband who is willing to pay the ETF that I can have him sign and exercise ? Something simple. They are very non-conforntational and responsible. I will deal with the deposit separately. He is handling her and her mother lives close by and expected she will move with her mother. They have been excellent tenants, but live happens. ANY form or wording to share for resident to exercise the ETF?

how you going to do ELT if they both don't leave? He could sign for him but unless she's out-- you have his wife as your new tenant.

Just use what is in the lease, this way both signed it before taking possession. In my area we go with 1 1/2 times rent and the moveout cleanliness still remains in effect as shown on the movein - moveout report, I always give a copy along with the lease and utility phone numbers. --76.188.xxx.xxx

Thanks Vee. Yes it's in my lease. They are 13 months into a 23 month lease. ETF is one and half one months rent. They are totally responsible. He makes more than enought money to afford everything and is very communicative. It's a good house and good people

We simply make a copy of that lease page and circle it with a blue highlighter and include the following MOVE OUT CALCULATOR form from the lease with their initials at move in.

Been using this for years and it does the trick.

Copy and paste the following onto a WORD document and realign the columns.

The lease states: Resident may pay this one time fee to

The official 60 day notice form is still required

Rent is for full months only, prorated on the move-in, not the move-out.

Other Fees: _______________________________________________________ $________

Carpet shampoo Required at move-out _____ rooms x $65 each =$________

Lease requires the carpet be professionally cleaned AFTER move out by

Management's designated cleaner only. Spots, stains, and repairs are extra.

If you prefer, you may call the carpet cleaner and ask about their specials,

and pay them directly. They require the water and electricity to be in service.

Give us a copy of their paid bill as proof of cleaning and payment.

Cleaning by home style machines is not accepted.

My ETF is very simple and included in the lease. "Pay $X and you can move out early. 30 days written notice required. The property must be vacant, all personal property removed, and keys returned to LL."

Simple and easy to understand. If not everyone is out, if there is personal property remaining, or the fee is not paid in full, the rent continues to be due until those conditions are fulfilled. The deposit cannot be applied to the ETF, but it is not forfeit either and I will return it ASAP. This gives them the carrot to help soften the blow of paying to break the contract. --107.216.xxx.xxx

here is what i am sending:

RE: Lease Clause #34

34. EARLY LEASE TERMIATION FEE: $1875. Resident may pay this one-time fee to legally end the lease early without being forced to pay for the remaining months of the lease. The 30-Day notice is still required. This fee is in addition to the regular rent due.

I will accept the notification to vacate date as received on Aug 1st as if you had given the required 30-Day to vacate notification at that time IF the following terms are met by noon on Aug 28:

1. August Rent is paid in full;

2. ELTF is paid;

3. Keys and Forwarding address are left on the kitchen counter.

If everyone is NOT out, if there is personal property remaining, or the above is not paid in full, the rent continues to be due and the lease remains in full effect jointly and severally.

The deposit cannot be applied to the ELTF, but it is not forfeited either and will be returned according to state laws and the terms outlined in the lease.

I ACCEPT AND WILL BE OUT BY AUG 28TH NOON
