Tenant is allowed off-street parking - 1 spot. HOWEVER - the car has a Rejection sticker from October 2018, and has not moved in many, many months. It needs to get off the property.

Tenant insists s/he is saving for a new vehicle, hopes to either use the junk as a trade in, or donate it.

Quick review of Rental Agreement - no clause re: parking/etc.

WANT TO ADD CLAUSE TO RENTAL AGREEMENT - for existing as well as future tenants - something like 'all vehicles on property must be current on all local/state/country requirements, including but not limited to: Insurance [certificate to be produced upon request by LL]; Inspections; Maintenance [such as no oil leaks, etc]; any vehicle not in compliance will be removed from the property, at the expense of the vehicle owner, within 30 days of written notice to correct, and correction not met

Anyone have a similar clause to share? Clearly, an oversight that this is not already included in the existing TAW.

VEHICLES TENANTS AGREE TO KEEP NO MORE THAN THREE VEHICLES AT THE PREMISES. THESE VEHICLES MUST ALL BE OPERABLE AND CURRENTLY REGISTERED IN THE STATE OF VIRGINIA. ALL VEHICLES AT THE PREMISES MUST POSSESS A CURRENT VIRGINIA STATE INSPECTION STICKER. TENANTS AGREE TO PARK VEHICLES IN DESIGNATED AREAS ONLY AND KEEP AREA FREE OF OIL DRIPPINGS. PARKING ON THE LAWN OF THE PREMISES CONSTITUTES A BREACH OF THIS LEASE. TENANTS AGREE NOT TO PARK BOATS, RECREATIONAL VEHICLES, TRAILERS, CAMPERS, OR ANY TYPE OF TRUCK ON THE PREMISES WITHOUT LANDLORD’S WRITTEN PERMISSION. TENANTS AGREE NOT TO REPAIR THEIR VEHICLES ON THE PREMISES IF SUCH REPAIRS WILL TAKE LONGER THAN A SINGLE DAY, UNLESS VEHICLE IS KEPT IN AN ENCLOSED GARAGE. I’m having a similar problem. Although my lease would allow me to remedy the situation, I’m going to pick my battles carefully right now. They are allowed off street parking . There is an eviction moratorium until October anyway. We both know what would happen if you told a judge you wanted to evict them because their car that is parked in their parking spot has a rejection sticker. It won’t matter that you are right. In my situation,the tenant’s car does not run. It’s not registered so I’m pretty sure it’s not insured. It’s not going to be a problem for me u til it snows. When it is not moved for plowing , my lease says I can have it towed and they can pay for it when they pick it up at the tow yard. Of course, the tow yard isn’t going to let them drive off with an unregistered and uninsured vehicle. --68.118.xxx.xx

@RentsDue - presently, the rent is trickling in. Not really looking at this from an 'eviction' perspective. Instead, I need to get a better handle on the Common Areas and/or the Allowed Space/Usage.

So, if I remedy the TAW agreement re: how long a vehicle can remain on the property without proper inspection/insurance/etc - then I can have the hunk of junk towed. But I need to write a supplemental TAW clause to Cover My A**.

If said tenant does not agree to amended terms, then we are looking at a Termination of TAW, and [gah] eviction, as well as Squatting/Holdover Tenant. --71.184.xxx.xxx

Deliver written notice to remove the vehicle within 10 days or it will be towed per STANDARD POLICY

‘Unauthorized, unlicensed, or inoperative vehicles may not remain on the property longer than 10 days and will be towed at the vehicle owner’s expense.’ Your new lease clause.

10 days is the Indiana requirement to allow a res to fix a problem. Use the number of days for your state. Often 14 days.

Also, in my city, if it’s on the road or right of way, with a call from the property owner the police will put yellow 72 sticker on the vehicle then tow it in a few days.

I've run into a different issue as a result of the moratorium, I don't allow un-registered vehicles. The city allows each property to have one. When someone buys a new to them vehicle, meaning not from a dealer, it takes up to 2 to 3 weeks to get an appointment with the registry of motor vehicles to get it registered. That sucks and I'm at their mercy because in a sense its out of the tenant's control. --66.30.xx.xx

Since they aren’t good payers, I go with plan b . I’m going to get some backlash for this on this site....but you are a MA LL so I will share . Go to Staples and get the 8’ x 10’ paper with adhesive on the back. Put it in your printer and use it to make “ FREE” signs. Stick one on every window of the car. No one will actually take the car because they need a title. A few will probably knock on your tenant’s door asking for the title. Your tenant will be mad but they will move the car. Even if they don’t, that Staples sticky paper will take them hours to remove. I wouldn’t do this to a good paying tenant, but they are bad anyway. It’s unchristian but effective. --68.118.xxx.xx

Outside areas including decks and porches must remain in receipt condition. No debris, No junk cars or car parts and No unsightly clutter allowed on the premises grounds.

I had a true tree shade mechanic - BF PITA - had a transmission in the front yard. I told him to get rid of it - he moved it to the backyard - out of site he claimed - what do you do with STUPID? --184.20.xxx.xx

Parking: No more than XXXX vehicle(s) can be parked on the premises for more than 48 hours without written permission from the Landlord, and all vehicles parked there must have current state-required inspections, tags and insurance and be in operating condition. All vehicles must be parked on the driveway and in the spaces designated by the Landlord, which can change from time to time. Should a car’s tag or insurance be allowed to lapse, or should the car become inoperable, Landlord, at their discretion, may have the car towed from the property at Tenant’s expense and Tenant expressly grants Landlord the right to do this. _______________ INITIAL
