Just running this through my brain. The no evictions law for "NONE PAYMENT" of rent is just for none payment of $$$$$. So if the reason for eviction is other than rent the LL should be OK to file. Such as tenant holding over beyond the term of the lease. Lease gets terminated due to "Pet brought" onto property or too many people or too many cars - not mowing the yard. YADA YADA YADA.
So if this is the case we're thinking of only doing M2M leases. If a tenant is on M2M that relationship can be ended by giving tenant notice. Tenant if they don't move can now be evicted for holding over or being a tenant at sufferance? NEVER mention No Rent as reason.
Do we really believe this will not continue until at least Nov 4th? If a certain bunch get into office-- 10 years from now we'll be regal ling each other with story's that start out--- "Yea I remember being a LL back in 2020 yea lost all those property's. My X tenants own them now. Gov't called me THE squatter and said I had no rights.

myob[GA],excellent idea! I did not know that the stupid no eviction executive order is only for none payment. Can we also bill them (of course they wouldn't pay) and put it in their credit report as debt? One day when they want to take out a loan to buy a house, banks usually make them pay all debts. I had a dead beat tenant came back to pay back-rent 3 years later after she got evicted because that was a condition to get a mortgage. --199.27.xxx.xxx |

Chicago LL when you take a court action - such as filing for non pay of rent-- with the court it is picked up by the credit company's. Here in our area many counties allow court records (which are suppose to be public records for all) to be viewed online.
So for us we get to see civil and criminal entry's. Paying old debts comes into play when the originator has done their part. By that I mean when you get a judgement follow through with the garnishment attempt. As you pointed out -- a few years later you never know whats going to pop.

Oh, I wasn’t criticizing you, myob. I agree with what you said. My city courts, depending on the judge currently doing small claims court, can be fairly tenant friendly. When I got started, ( only a week ago, compared to yours and other experience, ) we were in such a prolonged economic malaise, that I knew, if a tenant lost their job, had their hours cut, or ran into other financial trouble, in the areas I rent, those tenants were pretty much judgement proof ( oh, I could go after, file and all that, but, the likelihood of those tenants ever having two nickels to rub together, well those chances might be slim and none...) So, from the get-go, I knew it might be in my best interest to do MTM, then we could part ways more easily, AND, with my tiny number of rentals, if I have enough of a relationship with the tenants, they even may just make good on some of those debts. And, yep, I have collected. Just slightly shy of the full amounts, but in the one instance, heck, that ex-tenant has a lifelong seizure disorder, and breast cancer.... karma tells me in that instance, that she paid me anything at all after leaving is pretty dang good. (and, she did pay a goodly chunk.)
I guess I am saying, at the lower economic strata, it’s kind of like dealing with the pandemic always. It’s not till someone can move up above, oh, 40k or so (income) that they have many options. But, that’s where my darn ‘ ‘inner social worker’ comes into play, as best I can I teach tenants this to help them make some better choices. Teach a man to fish.....
( course, I suppose I need to make sure that teaching a man to fish doesn’t just lead him to spending all his dang money on rods and a boat, and pickup to pull it, lol! Pay rent FIRST, darn tenants!, lol!) --70.92.xxx.xxx |

Normal 30 day notice based eviction takes longer time in my state. Tenant has more time to answer and question etc with free lawyer.
Our court was open since June, my nonpayment takes almost 3 month from the day owed to court hearing (we notify on 16th with 5 day notice). If tenant appeals, another 2 months to superior court.
Oh, btw, landlord has to pay for all the fees, BS executive order, even though it is in the lease and has been awarded to landlord for as long as I can remember --50.245.xx.xxx |

Elliot our law here in GA is if there is an appeal the rent is paid into the court. Here in GA there is no legal reason not to pay rent so we know that we're good if appeal is made. That happened a few months ago. A tenant appealed to higher court and we requested rent while under appeal. Judge gave order to do just that and of course it was just a ploy by tenant for more time. They needed 1600.00 but only gave 1000.00. We requested the court give us at least the 1K and they did as we evicted the tenant. so we got something. --99.103.xxx.xxx |

I am glad that you posted this because I was getting the impression that nobody was realizing this. You can evict for other things.

Am I correct in that this is called a bond?
I think this is what the Judge told me before when I asked him about it from another case in court.

myob, here's another article from the MrLandlord.com facebook page that you may find very interesting. The article discusses how the pandemic has caused some cities and states to pass temporary rules that prohibit landlords from evicting tenants and restrict landlords from giving tenants termination notices, get this, even if they have a month-to-month lease. So landlords need to make sure they know the current rules affecting their area.

So back at yea on this. Tenant on month to month wants to give notice-- since tenant could stay if l gave notice why couldn't LL now reject "tenants notice" to leave?
What happen to the 2 way street?
All this is --- ONE big circle since most courts are closed and Sheriff's- at least in our area-- are not serving war rents. We file electronically and from the looks of it court cases are taking 30 to 60 days just for the court calendar.
Sheriff is so slow in our county there running radar guns on the highway. My take and th-is is not OFF topic-- forget the radar guns and start driving through these residential neighborhoods where trouble is brewing. Show a presence at least. As a property owner who drives neighborhoods every single day
ALL day-- I can testify with no reservation the police are sleeping or eating donuts somewhere cause you just don't see um..Radar guns--well it's easy picks ticketing mom and pops.
6X the court order said pay rent into the court-- and as it becomes due. When she didn't pay 1600.00 we filed for the writ of possession. Not sure if you would call it a bond because it was able to be changed every month as each months rent came due. --99.103.xxx.xxx |

I only do MTM ( because I am in Massachusetts) . While it is easier to get someone out It is also a “ no cause” eviction so the tenant is allowed a stay if they ask for one. They never pay during their granted stay because they are already being booted and don’t really have anything to lose by not paying. I have requested the rent be deposited with the court but it never happens. So we end up back in court where I tell the judge that they are abusing their “ stay”. That’s when I get a quick possession. It sounds like your court is a bit smarter than mine. The main reason I like MTM is that I can raise the rent when I want. --68.118.xxx.xx |

Oil spills from home auto/truck repair - EPA cleanup needed from tenant carelessness.

Dont know about your state but here it's also for termination of tenancy. In other words you cannot end the lease during covid even if not paying.
