Multiple lessons here. Tenant is moving out and I find a trampoline in the backyard. Obviously they are a pain to remove so the ex-tenant is dragging their feet.
I should have inspected better. Clearly they weren't hiding it, I just never went in the backyard.
My lease says no trampolines, pools, swing sets, etc.
Other than giving a notice to cure, does your lease have any fees or fines with getting one without permission?

My tenant put a huge trampoline on the front lawn of the rental -- so anyone could use it. With the liability issues and chances someone was going to get hurt, I issued my tenants a 5 Day Notice to Perform or Quit. Remove the Trampoline.
The tenant laughed at me. So I wrote my tenant a $100 check, the value of a used trampoline and told them I'll be back to cut it up and throw it out.
I returned with my battery drive and took it apart in sections, and stored it in the tenants garage....
I could have just as easily used my sawzall and cut in into small pieces and placed it into the trash bins.

trampolines are the only thing my insurance excludes, so they are an item on my lease along with all pools (some of which are permissible under code). I never thought to add a swing set, but no tenant has ever installed play equipment.
I realize you would kind of be stuck with the cure or quit remedy. In NY I can't charge a fee, or at least collect it as added rent. I do have a clause that says tenant will bear the cost of increased insurance premiums if they cause a condition that makes my insurance go up. --24.194.xxx.xxx |

agree, at least a drive by inspection is called for. My lease states trampolines, pools of any size, playground/gymnasium equipment of any type, and sandboxes are not permitted on the premises are a breach of lease subject to termination, eviction, and removal at the tenant's expense. --73.81.xx.xx |
