Can we NOT renew a lease during this time? We have a problem tenant, they are behind on their rent, we cannot evict right now due to courts not doing those. Their lease is up for renewal soon. It is in our lease that either party can inform the other regarding renewal or non-renewal with written notice. Can we just give them the written notice that we are not renewing their lease and to be gone by X date?

My attorney said I could do a non renewal per the terms of my lease. So I did. Unfortunately, neither of the two non renewals vacated at the end of the lease. Next we are going to try a Demand Letter from the attorney. If they don’t move after that, I still have to go to court. I am going to take the advice of having the holdover penalty be double the rent. --73.189.xxx.xx

When you do a non renewal and the lease ends and they do not move, isn't that considered "holdover" at holdover rates of 2X or 3X normal rent?

Of course, if they don't intend to pay anyway, they don't care and your rent could be %50,000 a month and they won't care.

I went to file summary ejectment yesterday on a holdover Sec 8 tenant. The clerk had to check with a magistrate, but told me it is permitted under the Cares Act to evict Sec 8 for holdover but not for nonpayment. --68.119.xxx.xxx

By Indiana law we can end or alter a lease with a 30 day notice.

Hold over rent should be in any proper lease.

Consider helping our lawsuit against the Govnr to end the eviction moratorium because he is breaking federal and state contract law. Indiana State REIA.

Lobbying is EXPENSIVE! and very necessary!
