OK I understand that courts are closed and the governor says you can't evict but is there no remedy for a tenant that doing damage to your unit ? Doing bad alterations against rental contract. Has anger issues and is fighting with the other 3 tenants who are so afraid of him that they won't call the police.

I hear your frustration.
I'd start by examining local code and/or municipal ordinances to see if he's in violation of any.
If no luck there, the word "reasonable cash for keys" becomes open to re-interpretation. A PO'd tenant can do THOUSANDS in damages in a very short time. Suddenly, $1,000 - $2,000 does not seem so unreasonable. I don't know what your rents are, but mine are $550 - $700, so adjust your offer accordingly. Every month is that much $ lost plus whatever he's tearing up.
I think if these moratoriums go on much longer we will see more self-help evictions. The police are already over-tasked in many areas keeping law and order among protesters and rioters. I doubt they would be able to respond very quickly if 100s of land lords start throwing people's junk out on the lawn the same day.
Agreeing with Richard: we're seeing a stress test of the system. If it can't keep up, people will find their own way and cross their fingers that they don't get caught. --107.216.xxx.xxx |

Cops are unlikely to do anything. Suggest you find the local Hells Angels or Mongols Motorcycle Club and pay them to visit your tenant and suggest he pay the rent and stop what he is doing. Consider filing based on LEASE VIOLATIONS,
-unauthorized animals
-unauthorized modifications to the building which are against code making it unsafe to inhabit and endangering the other residents
-criminal activity
-fire hazard, using the grill too close to the building
Several months ago the housing inspector CONDEMNED my rental due to hoarding and lack of sanitation (nothing I did). The folks had to leave. If there is a missing screen or a cracked switchplate the home does not meet health and safety code and can be condemned.
CONDEMNED does not mean TEAR DOWN. It means something is out of code. Make the repair and they lift the condemnation.
Our Indiana State REIA paid an atty to file a lawsuit against the govnr for interfering with federal and state contract law. Plus he allowed other businesses to open and charge for their services.

one thing I've found out about being arrested. Normal people who break the law don't know how to act. A career crook and disrupter-- works the system. Mr. and Mrs. LL aka mom and pop manager gets threatened by police and they fold and get sued and worse get locked up. The disrupters have rich people and politicians bail them out of jail and with our money. It's sickening.
The law won't lock up people burning down the town-- why because they have armed themselves against he police. Frankly the police are afraid of them (I hate to say it but it's evidenced by the lack of cops at the recent store burnings and frozen bottle tossing competition we've all seen on TV. So they either go for the really bad boys-- or US the LL setting out tenants-- who's the easiest target?
So I ask-- what is the current property status as far as a mort or not-- is it making money or a money pit? Do you want it? or can it go to foreclosure and what are your states foreclosure laws. I know I know you don't want that to happen-- sometimes you need to eval the system and your situation--.
I've told 17 lenders at one time or another to stick it where the sun don't shine. Threatened and did walk on several-- but here in GA they only have 30 days to go after you-- and in superior court not magistrate or state court. Each claim costs them 25,000.00 just to seek the money.

I am disgusted by all of this. The courts are not closed. Tenants are bringing cases against their LLs. Go on to Masscourts.org and you will see that many tenants are getting ROs against their LLs . I keep seeing notes in there like “ defendant to prove why......”
1. Access needs to be given to landlord
2.Unauthorized guests are not allowed
3. Dogs are not allowed
4. Unauthorized vehicles are not allowed
5. Utilities have been shut off
6. Defendant is disturbing plaintiffs right to quiet enjoyment
Etc.
Anyone who can read between the lines knows that these are all tenants who did not pay the rent so the LL is trying another way to get them out. The “ quiet enjoyment” piece really brings it home. Not only are you supposed to house them for free, how dare we bother them by asking for rent or to abide by ANY terms of the lease. Some of them really do think they own the place now. We LLs are supposed to have protections from the moratorium if they are a threat to property or safety. It sounds like this man is. I would get the police on board. If he is threatening anyone or destroying property it is not a civil matter. If it takes him filing against you to get in front of a judge then it’s not a negative. It will be a lot easier to get there that way then you filing against him. If I need someone out that is how I will get expedited. A counterclaim can get you a judgement and possession just the same. --68.118.xxx.xx |

What kind of damages is he doing? Make sure you document everything & maintain a through paper trail so that when you finally get to court you'll be prepared. Are any of them safety issues? Can you prove that he is doing them? Have you called the police about it? Is there any way you can get a restraining order against him?
Do you believe that the other tenants are afraid of him or are they just saying that so as to not get involved? Are the other 3 tenants current on their rent?
Do you think that any of the neighbors might support your efforts to get rid of him?
Every time he does something inappropriate call the police, city / town hall and your selectmen / councilors. Have you considered talking with a lawyer about this?
Unfortunately our wimpy governor & the gutless legislators are too busy pandering to their perceived voters aka tenants to be bothered to care about LLs.

My understanding is even with the eviction moratorium you can still evict, assuming the courts are closed. You just can NOT evict for non payment of rent. As I read the order (at least in Maryland ) you could still evict for other reasons. Now in practice how that plays out may be a different matter. --108.56.xxx.xx |
