I sent a 30 day NTQ for Aug 31st to my mom tenants. Girlfriend notified me via text that they split. Boyfriend wants to stay, although I encouraged him to vacate quickly with no damages and I would not file. He sent me a partial rent payment today, along with a few nasty texts about him calling code enforcement and condemning my property, and that he has tenants rights. I really want posession of the property, as these tenants have screwed me over with late rent every month and damages to the property. Any advice on how to proceed?

Return the partial payment. Proceed with eviction. Check on property regularly during process.

Do they have utilities in their name?

In future would recommend running thorough credit checks on all adult applicants as this is going to weed out problem tenants. The upfront cost is worthwhile many times over as problem tenants are in the never ending eviction cycle. Consider joining a landlords association where google to find. Tenant threats are nothing new. It's part of everyday life of a good property manager to deal with difficult tenants. Ignore and proceed.

In this case since you gave notice to quit, accepting payment for THIS month's rent should have no effect on anything. Next month may be a different story, although in my state I can still accept payments because they are in holdover status and rent automatically doubles, per state statutes. Partial payments do not delay evictions in Missouri, at least not in my courts.

Your time to take action comes if they overstay after Aug 31st. Be patient and ignore their threats. Fix legit issues as reported to keep your nose squeaky clean. Bill them for damages.

Did you actually serve a notice to quit or just gave them a non-renewal? Totally different. Eviction moratorium has been extended again in CT to September.

Hi Zakhd, I served an actual notice to qui it.for non payment of rent as of Aug 31st. This is turning more into drama, because the fiance said she vacated due to domestic violence and her name should not be on the filing. However, she has not produced to me a police report or a restraining order which is necessary in CT for me to do so. I sent a disposition of deposit of the recent payment and applied it to damages first, so it did not cover rent due. The boyfriend claims he will have more money on Friday. No, you are correct girlfriend has to be on the NTQ whether or not she is living there (if she is on the lease she gets the notice). You only have to give 7 days in the NTQ so I'm not sure why you gave so long for them to vacate. Also, I would not have sent the security deposit disposition until they moved. You have 30 days until after they move to provide. It's on them to ASK you for the accounting not the other way around. If you accepted his partial rent, after serving the notice you may have just re-instated the month-to-month. I would not accept any more rent from this guy. If the lease is up, NTQ should just state "lapse of time" for the reason. --32.211.xxx.xxx

How did you make out? I was just reading this: Landlord's Right to Evict

While a landlord cannot serve a notice to quit or initiate an eviction action for nonpayment of rent until August 22, 2020, a notice to quit may be served on or after August 22, 2020 and an eviction action initiated thereafter for nonpayment of rent for ant part of April through August, 2020, or any other month, if the rent has not been paid.
