State Specific Question About: FLORIDA (FL)

Can someone help me in getting Govt office name and number for University of Florida, Gainesville area apartment complex complaint.

My son is a student at UF and signed a lease for 12 months with an apartment complex, The Nine.

Now due to Covid-19 he cannot attend classes on campus and is doing only online.

Leasing company is not allowing us to break the lease or even defer for one semester.

I can not afford to pay rent at this hard time.

Where should I complaint.

This is a landlord site. I am afraid that none of us will have the information you seek, and also that our sympathies are in the other direction. Is your son's landlord part of the university or is merely a private landlord catering to the university community?

The landlord is not responsible for the virus or the school's shutdown.

If your son had flunked out of school or had been expelled for kissing a girl without her written notarized consent in a University approved form, would you expect the landlord to let him out of his lease?

I know this is landlord site and I am landlord too with apartment complex in fl.

Lot of prospective tenants back out before moving in and can cell the lease and i happily give them back deposit and rent back.

I am ready to pay even 2 months rent as liquidated damages to complex but they dont allow.

Any way my son did not got caught kissing or got expelled just because of Covid 19 classes got cancelled --47.205.xx.xxx

Yeah, they probably have an early lease termination fee. Does the lease say anything about subletting? Actually I just found out that someone locally is using a rental for an AirBNB. You have an apartment in Florida that is probably desirable during the cold northeast winter. Can you get some so so furniture in there if there is none and sublet it to people who want to spend time in FL there? I guess the complex management is so desperate to get money that they are just not letting one out at all even though they probably would under normal circumstances. I would start advertising it and book those cold winter months in there to people outside the state. Get deposits and pay the rent. Sign up with AirBanB also and they will supply short term rentals to you. You could make a fortune --71.104.xx.xxx

Lisa, from the web, “The Nine” is owned by a private company, Scion, that owns over 55,000 apartments.

I don’t think there is anything the University can do about the lease, as it isn’t part of the University itself.

What does the lease say? Is there a early lease termination clause?

If it doesn’t mention it, he (you) might be stuck. Any chance of subleasing?

It took me three months to get a refund from my daughter’s college dormitory (prepaid at the beginning of the semester) that forced her out at the beginning of the Covid.

No place to complain to since no laws are being broken.

And nothing illegal about the lease.

That said. If it goes to court the most a Judge would allow me is one months rent. This during normal times.

I am surprise that there isn't Early Termination clause. Fl added that to our LL/T laws around 2013-2014.

I think I would have my attorney send a letter(s) to both the Landlord and the University, since the University caused a lack of need for housing in G-ville.

There is a Housing Board that does help students mediate housing issues. Summer of 2019, while waiting for appointment at Shands, I saw an advertisement in the University newspaper.

Just read an article how many students are still living at the college for the social life and to be independent even tho all classes are online.

Some colleges are hoping to open up for second semester.

LL rented to that special angel of yours in good faith. He, the LL is not from WUHAN but born in FL. His business is customer service and supplying a service. You and angle accepted that service.

Now comes the real life experience for angle boy and angels mommy. Check in to apartment-- tell angel to get a job while hes waiting on classes to begin and while taking his course. This is a perfect time to check out the job market ( if there's no excuse from student for doing so.) Student (who is no longer an angel since he's been in college for 4 weeks) will love the experience of being on his own and making his own decisions.

Second-- you could complain to husband or X or relatives but hit the ol parish preacher-- he'll be sympathetic or U could find other parents in the apartment complex. That would even be better.

Silly question-- when did you sign this lease and why isn't student in student housing on campus? --99.103.xxx.xxx

Lisa,

You say you are a Florida landlord, so you should already know that Per Florida law, the apartment complex does not have to allow you to break the lease or defer rent payments.

Ask if your son can sublet the unit. If not, then he (and you, if you co-signed or guaranteed the lease) are stuck with the monthly payments.
