State Specific Question About: GEORGIA (GA)
I just found out a guy has been renting a property I just found out I still own for the past 2 or more years. I have the deed and tax records to prove my ownership. I went by the property and found out a tenant is in there and he gave me the name and phone number of the person he has been paying rent to
The tenant says he pays $400 per month for 1 room. The house has 3 bedrooms and 1 bath. This is a case of fraud and I have opened up a case with the local police department. My question is How Do I Evict whoever is in there without having their names? My intention is to put the house on the market and sell it. Strange story. This person has been paying someone rent. You may not be able to evict right away. You need to find the best eviction attorney around who has access to a good criminal attorney also.

If this person has been paying rent, perhaps screen him & start collecting it yourself. It may be a while before the mess is straightened out so you can sell it - might as well get paid.
Meanwhile, go after the person he has been paying with everything you've got!
Are you saying this person has been living there - unknown to you - for TWO YEARS?!

How could you not know that you owned this property for 2 years? Who has been paying the taxes on it if you have the records?
I doubt you can evict if the tenant has been paying rent in good faith to someone he thought was eligible to get that rent. You need to ask the tenant who he pays the rent to, if he doesn't send the money and someone collects, be there when he pays the next month with the police. Get a lawyer.
However, this is probably not the time you are going to get much help from the police, they have other more important things to do. And it probably isn't a time to sell unless you are doing it at a very reduced price.

fishy post. The process IF YOU ARE THE OWNER is post a notice to vacate (post on door, mail and then certified next day delivery. After Notice say 10 days-- file for a dispossessary as tenant holding over / suffurance.
You don't need tenant name-- it will read JOHN DOE OR TENANT IN POSSESSION.
cHECK OTHER IN BOX FOR REASON: tenant unknown to owner-- SQUATTER.
Will be hard to get served since courts are closed-- but it needs to be filed in Magisitrate court. Sheriff will post on door- tenant will have 7 days to answer-- if answer 10-14 days for court hearing---- if no answer-- request Writ of pOSSESSION WITH COURT. (25.00) magistrate court will send to sheriff for set out in about 14 days-- if your lucky.
I also was going to say how could you own it and not know it. Thinking from past experiece we had a developer in our county who owned countless property's and raw land ( he was found in upstate NY on his 11,000 acre property-- under suspicious conditions. My friends wife worked for the law firm going through his estate and they found many proeprty's that he owned but tenants in them never paid-- for years-- like 10. So it does happen.
