State Specific Question About: ILLINOIS (IL)
How long do I have to keep abandoned personal property? My tenants moved out and left a couch, clothes and a table. Do I have to keep this for a certain amount of time? Or can I just get rid of it?

That should be addressed in Illinois landlord-tenant law. Look in the upper left area of this page for the blue letters that say "Landlord/Tenant State Laws" and find yours.

I find it silly to require LL to hold onto tenants stuff after they move out.
Either the tenants have voluntarily relinquished possession of the property and everything in it can be disposed (and charged to tenant), OR the tenant has NOT vacated and must continue to pay rent.

I'm with David(MI) on this. It's nuts. However, it's the law. Here in KS, it's 30 days. We can charge storage fees however. Collecting any of it rarely happens. I think in the last 20 years, I've collected it once. Guy was evicted and didn't think he had to move. Cops proved otherwise. I moved his stuff to storage so I could get the unit cleaned and ready for rerent. He came back and was FUMING mad that I moved his stuff. You can only imagine what he was like when I told him he needed to pay storage fees before I would release the stuff. Haha! --68.102.xxx.xx |

May of my low class tenants are always thinking of ways to get something for free.. So they leave junk behind and then claim I never allowed them to recover their priceless property and sue me in small claims court.
With pictures of the property take at the time of Sheriff Lock out with pictures of the Sheriff's name plate and badge number... I can prove to the judge the furniture wasn't in prime condition when they were evicted and left it behind. --47.156.xx.xx |

once again, I am baffled. Robert, are you telling us that sheriff deputies actually move around room to room and pose for you in front of - depending on the beholders eye- worldly possessions or trash allowing you to photograph them close enough so that you can read their badge number and name?
