I have an opportunity to purchase a very small, one room cabin on a river here in Nebraska. This would be for my personal use.

The cabin is on leased land and was built in 1977. The original owners are selling it and back when they had it built, they never had a title made. I checked the with court house and they dont have any record of a title, however, the owners do pay a yearly property tax on the structure. It is only around $90 per year.

How do I go about purchasing this property without a title? Do i make a purchase agreement detailing everything and we both sign it?

On leased land? Government land? I suspect that you get the lease signed over to you stating grounds and buildings. But maybe consult a real estate lawyer?

First thing I would want to know is who is the land leased from? Is there a problem with it being that close to a river? Is there some environmental group forcing them to leave? Does the lessee have the right to lease, I think it's called riparian rights land or that may be something else. Maybe that land close to a river is government land. Is the cabin "affixed" to the land legally?

What happens if the land owner says they are increasing the lot rent to $1000 a month?

or if they say "take your cabin off the property"?

This isn't a forest service lease is it?

This may be a property that may not be passed forward or passed outside the family.

How much they asking? If its little $ do the Cris columbus purchase.

Seems a little "iffy." Sounds like you need to talk to the lease holder, square that away, then give the seller $ for the building.

We've looked at a couple of forest service leases, the properties were pretty rough. Mostly built in the 30's under the work programs. And the FS is always increasing rates. Though still seem pretty reasonable considering what is the price for beauty and solitude.

I say if it's in your budget and desire and all the legal issues are clear go for it! Ideally a fee simple would be better. Any chance of buying the lease? I know back east a lot of folks have hunting leases and cabins. It's less prevelant out here.

Our grand plan (got set back by my health issues but we seem to be getting back on track) is to build an off grid home with some space (like 600 acres) around it as a family retreat, that my spouse will have after I'm gone. I'm really tired of city life. We moved to the desert to escape the crime and traffic, but it's followed us and getting worse. I don't want to see or hear neighbors in my next home! --47.216.xx.xxx
