Can a tenant that has received a code violation citation stuck to the door go down to the pre-hearing conference or does the owner have to go? It implies owner/agent/person in control of the property and I'm assuming the tenant is 'in control of the property' since they are leasing it. The tenants got a raw deal and want to dispute it. This is the city of Dallas. I have called the inspector and his supervisor but they won't call back. Thanks for any guidance.

Here in SC, it depends on the violation. For uncut grass, the tenant is liable. For a structural problem, the LL would be.

I would go in then visit the property standards to see what the building code violation is. Some towns and cities have the property standards on line. A example is no loose or missing plaster, all surfaces must have a coat of paint although the colour does not have to match. No loose or missing floor tiles again do not have to match. The roof must not leak along heating, plumbing, hot water system must work. All the locks including the bathroom door must work. All the electrical boxes must be covered no exposed wiring. Some minor property standards can be cleared up in about hour where others take longer. Had a tenant complain about mold around the bathtub along with the grout between the floor tiles. The problem was the tenant was doing laundry in the bathtub where the apartment building had laundromat front load washing machines and commercial clothes dryers. Went down to see the person above the building inspector then ask what can one do if the tenant was doing laundry in the bathtub where the exhaust fan would not take all the humidity. The main building inspector agreed with me that the cause of the mold was the tenant. Often tenant look for ways to stop or delay the eviction where best to confront the building department then correct. --147.194.xxx.xx

In my part of Texas the city will put a lien on the property for unpaid violations. The tenant may be able to go but ultimately if they don't work it out or pay it it will fall to you as the property owner. --50.26.xx.xxx

My properties have received many property violations in the past. Many times the City sends the notices to a prior owner who's been dead 20 years or to the wrong address.

The top reason why I got my 6 contracting licenses is to fight City Hall on Codes, Violations, Permits, etc. The City doesn't care if they are wrong, they don't care if a tenant is in danger. They only care to earn extra fee's to line their pockets with salary increases and bonuses.

I would go to every hearing and Tape Record the "show".

It would be best to go to the hearing, the tenant will think up 487,386,213 ways to make it your fault unless she/he contacts an atty then that number will multiply, however if you hae recently won a 6or 7 digit lottery let the tenant help you burn away the profits. --76.188.xxx.xx

I don’t know about Dallas, but in Denton I once received a code citation (these are sent to owner) for a mattress propped up against the shed at a rental and visible from the street. (photo sent with notice ) I was given a date by which to remedy the violation so I told renters to remove it. They did & when enforcement drove by on due date they verified and dropped the citation. --107.77.xxx.xxx
