State Specific Question About: DISTRICT OF COLUMBIA (DC)
Lease agreement executed by tenant on July 10 (for move in on Aug 1) and security deposit sent by mail. On July 14 tenant sends email saying she is moving elsewhere and informs me she has cancelled payment on check. What remedy, if any, do I have to hold tenant to terms of lease (at least until I find a new tenant). --205.201.xxx.xxx |

In the future, all deposits cash only. If you do take a check, go to their bank immediately and cash it.
Tenants pull this all the time. It's likely they just found a cheer place. 99percent of excuses are lies.
NEVER EVER EVER call it a security deposit. It is a non refundable HOLDING FEE. Get it in CASH!
Have an Early Termination Fee, signed, initialed and agreed on.
Know where they work.
If they don't work, are they collectable? (Some states, you can't collect). Some types of income (disability or social security), you may not be able to collect.
File on them and get a judgment if you can.
If they are not collectable, either get a strong local, collectable cosigner or consider not renting to them.
Most likely in this case, you're not going to get any money. Learn where the mistakes were made, adjust and never make them again.

Some of the advise you get here may not be true for DC.. best to check
Monies: I'd suggest the first payments / deposits/fees are by cashiers check only.. cash can be dangerous especially in a big city..
Make sure you can call it a fee instead of a depoist.
Agreemet starts: when it is signed, funds exchanged as will as keys... again do not do holding

This is a low cost wake up call, get the newest ersion of state and local tenant rules before you open for business so you can answer these questions while in the presence of a tenant, and how does your housing court judge respond to these type tenants, visit at least twice a week for a month before advertising an open unit. --76.188.xxx.xx |

Ll'ing isn't like throwing a fish line in the water. Kick back and wait for the line to go stiff. No it's knowing when and how to bait the hook-- what area to fish-- and how to protect your lines in the water from all that debris trying to drag your line and ROD into the water. You read here for a few days on topics that you are lacking (MOST) and you'll protect yourself--SOMEWHAT.

I don't have a lot of experience myself but I will say I would require the lease signing and security deposit in person and it should be cashiers check or cash and check the cash. I will let the others with more experience give you more advice.

Tenants dont execute lease... it's Landlord papers. You executed lease, they entered the agreement.
