I won't have to rent to convicted felons. I will find other ways to deny them. The creative LL always finds a way around silly regs like this.

People with seriously troubled criminal pasts have many other factors that are legitimate for denial. In other words, I have yet to receive an application from a convicted felon who had good credit, good LL references, sufficient income from a stable source, screened well online, and was cooperative with my processes. Most are too lazy to follow the application process, have multiple unpaid accounts, have no LL refs or poor refs, job hop continually, or have all kinds of crazy pictures on Facebook.

This is nothing new and is already spelled out in Fair Housing laws. You can't have a "blanket policy" like that where a person is automatically disqualified just by ticking a box on a form. You have to consider each case. --50.82.xxx.xx

I hope someone else here can correct or update me on this but my recollection is that the last prez was on a Sunday morning talk show - maybe in 2014. He made a comment that he didn't think it was fair that a renter could be denied simply because of a criminal past. Don't think there was actually any legislation on this but I could be wrong. That comment sent a ripple effect fear to rental property owners. --73.215.xxx.xx

The suit suggests that you could consider how long ago a conviction was, how potential renters conducted themselves after being found guilty, evidence that applicants have rehabilitated themselves.

But if you considered this it seems you would still discriminate. Since you would be renting to mainly white felons.

In Chesterfield county 20% are minorities. But 46% have been convicted of a felony.

I can see it now. You get the text from one of your renters: "I just read in the paper that the guy who moved in downstairs is a convicted felon, he's the one who committed murder on blah blah. Frankly I'm confortable with it and all, but my wife doesn't feel safe and she's expecting. I know its silly.... but we will be looking for another place she just won't live here. Moving out at EOM."

Another renter to first renter: "Moving out?"

"oh yeah my wife isn't comfortable here anymore. The guy that moved in Unit A is a felon. Its in the papers...."

The problem is coming up with the written criteria that would not be discrimination.

Unfair for this Apartment complex to have to be the test subject.

But maybe they will force HUD to actually define a criteria that they would consider acceptable and within the law.

So far I know some LL that say they dont automatically refuse a felon. But if they are challenged they cant say what felons they would accept. Much less have anything in writing. --73.152.xx.xxx

Los Angeles Housing (rent control) and the City's / State's Section 8 make it mandatory to rent to felons that are Non-violent.

So a comprehensive background check reviled the fellow was a child molester. If I don't rent to him, then Section 8, the City and State won't make their commission. So the wanted to twist my arm to take him.

I refused since I have children at the property. But I gave the felon a list or available rentals near to City Employee's with kids..... Let them deal with it, I'm not going too. --47.156.xx.xx

I refuse Violent Crimes - against people OR property. Assault, Burglary, etc. I don't care about a DUI or possession, but trafficking in hard drugs, no.

Especially when they lie about it: "I was charged with fighting with another girl, I had just turned 18." She was in fact charged with Assault while Inflicting Serious Bodily Injury...and then a minor possession charge too.

"I had a possession charge a few years ago." And a Conspiracy to Traffic in Heroin charge, he just forgot to mention that one.

"Just a few misdemeanors, when I was much younger." MULTIPLE arrests for Damage to Property (? I don't even know what that charge means, but it ain't good!)

So anyone who seems willing to inflict harm on other people, or on other's property: no.
