I got the situation:

I took the advise from this forum and added the grandma as the guarantor when the rent does not pay.

The July rent is 15 days late, talked to the grandma, the guarntor to pay the rent for her granddaugher, she said she has no money.

The grandma is not on the lease, but the grandma has signed the gurantor to pay the lease when the rent does not pay.

Is it true, when the nonpayment eviction files, the guarator will be in it, and the judgement will also against her, too? She owns a property, will the lien be on her property?

Please share if you have some experiences on this matter.

Well in my state.

You file for judgement against both at the same time. In general district court.

Once you have judgement it is suppose to attach to the property. But not always automatic.

So to make sure. We go to the circuit court clerk and pay something like 15.00 to make sure the judgement is recorded on the deed.

The circuit court handles the recording on the deeds.

And then you pay a small fee every 10 years so the judgement stays active. --73.152.xx.xxx

When I tell a guarantor that their "son, daughter, friend or x-wife" hasn't paid their rent, they respond by saying "I talked to them and they said they paid! Can you prove they didn't"?

So I have to first evict the tenant for non-payment of rent. Then once out, I now can sue the guarantor for the amount owed.

Instead I don't take guarantor's. Instead I get them to co-sign the lease for the first year. They put down that they often visit their "child" and will stay over once in a while -- that's why they are on the lease.

NO one want's their credit destroyed, this way they pay up..

I can tell you for sure I did NOT "give the advice you took on this site."

I don't do guarantors. I make the person sign the lease. If it had been me, grandma would have signed the lease. Guarantors are only responsible for rent, not the other problems that can come up in a lease.

As others have said, you need to get her served and dragged into court....but if she's telling the truth and has no money, you'll be squeezing blood from a turnip.

Btw, for future reference, my criteria for co-signers (who sign the actual lease) are as follows:

1) STELLAR credit score. No late pays. No judgments. No collections. This typically means the person is mid-700s or higher.

2) Income of no less than 6x the monthly rent from a source I can garnishee.

3) Owns LOCAL real estate in that person's name.

If a person meets all of those criteria...they will have money when the tenant fails to pay. Again, have them sign the actual lease as if they were a resident, making them responsible for everything from rent to damages to mowing the yard.

I also doubt anyone suggested a guaranteor, that is like thinking up future lottery numbers. They sign the lease along with the regular tenants, in TX you can not take salary so you take property but with no connection you are chasing a small ball in tall grass. --76.188.xxx.xx

I get guarantors on all my first year college student renters. only those with property which I can always file abstract on should I ever need to get a judgment. in 20 years never had to. I do not do co-signers. evict & file suit against renters & granny. not sure why you are on day 15 & did not post 3 day pay or quit. lesson learned... --70.119.xxx.xxx

Cant say I understand Vee on this one.

At least here only advantages and no cons to a guarantor.

The courts treat them just the same as a co tenant on the lease.

My Guarantor agreement makes them responsible for all the terms of the lease including damages.

Dont no why anyone would have a guarantor agreement for only rent.

If so a co tenant would be better to help cover damages.

Getting judgement and collection is also the same.

So no cons and maybe a few pro's

Only have to deal with one tenant if any issues.

No roommate or co tenant issues to deal with

Co tenant cant terminate lease

My responsibilities in the lease only apply to the tenant.
