I have a 2 family home which I live in and my other apartment I rent to a recently wed couple. They have been living there for over 5 years now. Good tenants, pay on time, etc.

About 3 weeks ago I noticed that the husband's car hasn't been around and I haven't seen him either. IDK their personal situation, but as a landlord am I able to or should I ask if something is going on?

My concern is about the ability to pay the rent if one of the tenants in no longer in the picture for whatever reason. thanks

That's a bit nosy. I think that's crossing a line. However, if your suspicious, then save up some money in case there's a lapse and don't hesitate to start eviction the day after a payment is missed.

Just be glad you know what to expect and can prepare for it. But, it's really none of your business and asking could work against you during eviction. Just play dumb and prepare to react. --108.69.xxx.xxx

I noticed a friend staying over a couple of nights, but not consistently. They are on a month to month lease. The rent is a little below market rate and a single person should still be able to afford it. I'll just see what happens and not bring it up unless there is an issue with the rent or if she has a new person in there. Thanks --69.74.xx.xx

Really none of your business until the rent isn't paid. There could be a lot of valid reasons he isn't there.. illness in out of town family, training for the job, vacation etc. The friend might just be keeping company while he is gone. I've actually been in this situation. When my ex and I were splitting up, a nosy HOA board member came over and point blank asked me what was going on. I point blank told her where she could go.

My point here is if something is going on and you ask, you might get a very bad response. In looking back, I didn't handle it right. However, tensions were high because of the other stuff going on and this board member was the last person I wanted to talk to about it. Therefore, tread lightly if you do ask. I don't think I would recommend it. Just make sure rent is paid and all the other lease terms are being followed. I could actually see them (one or both) coming to you and asking to remove someone's name from the lease after they get their personal matters taken care of. Your job as manager is to keep an eye on things, to be PRO ACTIVE, to head off problems BEFORE they happen. Not wait until they are late on rent.

Do not be an ostrich. This is not being nosy. The stability of your resident IS your concern.

Doogie’s “nona yo bizness” answer told the asker there was trouble. (why should an HOA care anyway! I think that guy was being nosy...or looking for a deal on a property!)

You live in the same building. Talk to her. She might be relieved to talk aboit it.

Being the boss means tackling the uncomfortable stuff. With diplomacy.

I might make a casual remark. If there is someone else staying there, I would want to know their background-maybe not credit check but I would check their criminal,etc. If it someone leaving in a week, I probably would not care unless they were being an issue to the neighbors. --73.230.xxx.xx

You can't evict for non-payment until they haven't paid. Unless the answer to my question above reveals something significant, I would not ask but watch closely to make sure rent is paid on time. If something is going on and she wants you to know she will tell you. --70.178.x.xx

I bumped into my tenant today and she told me that she separated from her husband and he moved out. She said she doesn't plan on leaving and making the rent won't be an issue. She also realizes the rent is below market, which doesn't hurt.

Should I draw up a new lease for only her considering he is not a tenant any longer? They have been on a month to month lease. Would he be on the hook for payment in the event she was delinquent? I don't foresee that happening, though. Thanks --68.129.xx.xxx

I’d get a new lease with only her. Before, I have given a 30 day notice to move so as to legally get the other out.... the idea is that you don’t want him coming back to move into “his” apartment one day. This opened up some more questions:

- Does email count as writing to me to be official if I can get in touch with him or does he have to mail me a letter?

- I print out a notice and tape it to their door to give notice, but he won't be there to see it, so does that still count?

- Do I return the deposit to her and then have her give me a new deposit again?

Don't over-complicate things. If they are on M2M, just sign a new lease with her. Deposit stays with the house until the last tenant leaves - let her deal with that with him.

I would think that if he doesn't inform me in writing that he is out of the lease I could go after him for non-payment if she for some reason doesn't pay the rent. I don't foresee that, but then wouldn't it be in my best interest not to sign a new lease? --69.74.xx.xx
