I'm in the process of making arrangements so I can receive rent through zelle. (Opened a USAA personal account, that can receive it, then I can send it to my operating account at a credit union that does not do zelle. This will be one more step and a bit of a delay, but one step up from current practices)

It's a bit unclear to me on their website, and in a recent post someone asked how to stop them from paying when evicted.

Does anyone have experience with this/ know that answer?

Also, can a tenant reverse a zelle payment?

When sending money via Zelle, the instructions say a payment cannot be reversed.

The only way I can think to stop a payment would be to change the email that accepts it. Which would affect everyone who uses it.

Since I have never had someone pay during an eviction, I don't even worry about that. --50.82.xxx.xx

In my county, once an eviction has been filed, I have every right to collect any rent that is currently due. (this info came from my attorney). My accepting rent after the filing, via direct deposit or any other means, does not change anything.

When I file eviction papers, I make it clear on the Unlawful Detainer form that I am evicting for "Failure to Pay Rent BY THE DUE DATE". --68.63.xxx.xxx

I have had several tenants pay rent after I filed eviction papers. Again, that does not stop the eviction from moving forward. Usually, they will ask for a court date and try to tell the judge they did pay rent,...but again, I am evicting because they consistently could not pay rent by the DUE DATE. --68.63.xxx.xxx

True, Roy, when I file for an eviction I do not check the "Failure to Pay Rent" box, I use the "Violated Lease Terms Described Below" or whatever the exact wording is, and then say "Failed to Pay Rent by Due Date" and usually there were other violations anyway. --50.82.xxx.xx

On every eviction form, I have a 'pre-printed note' that I use scotch tape to attach to the hand-written Unlawful Detainer form. This typed note says:

1. Failure to pay rent by the due date.

2. Failure to pay rent and late fees by the terms of the 7-day Pay or Quit notice.

3. Failure to vacate by the terms of the Pay/Quit notice.

In our county's Eviction form, you can only select the following:

1. Unpaid rent as grounds for eviction,

2. Holdover as grounds for eviction,

3. Other grounds for eviction/lease violations (other than non-paid rent)

So when rent is not paid, the #1 becomes the choice. Where you can not emphasize you evict because they did not pay rent BY DUE DATE.

Wondering in this situation, if they paid via Zelle, will it stop the eviction? --47.187.xx.xxx

When my first ever tenant to USE Zelle ( both of us were new to it,) the tenant accidentally double posted that first payment ( rent plus security) she was NOT able to reverse it. The bank had her call me, I quickly sent the extra payment back, and the bank kindly eliminated the overdraft fees she got because other bills hit her account. ( Chase bank, btw. They were wonderful about walking us through the process.)

The double post occurred because there is ( or wait that time, dunno if that has been resolved,) a lag between her sending the money and it showing on HER account that the money went through. What she and I learned was, if not sure the payment went through, she ( sender) should contact me (recipient). I was able to see the payment on my end, just hadn’t ACCEPTED that yet. Now, I don’t have to accept the payments, they are already ‘accepted’ when they hit that same account.

Now, that was during the verification phase, but, I think it holds up that sender cannot claw back funds sent. --70.92.xxx.xxx

Four reasons in NC:

#1 The defendant failed to pay the rent due on the above date and the plaintiff made demand for the rent and waited the 10-day grace period before filing the complaint.

#2 The lease period ended on the above date and the defendant is holding over after the end of the lease period.

#3 The defendant breached the condition of the lease described below for which re-entry is specified.

#4 Criminal activity or other activity has occurred in violation of G.S. 42-63 as specified below.

The first one is really only used with verbal leases, I was told. Otherwise, the lease is the notice and you check #3. --50.82.xxx.xx

WMH [NC], interesting! I would think #1 applies more to most of the non-payment eviction. In TX, It specifically said "if other than non-paid rent" for "Other grounds for eviction". Wondering if landlord here in TX can share some of their eviction experience here? --47.187.xx.xxx

I just tried to make a "test" transfer with Zelle - into my new account.

Wouldn't do it. Call the Number, etc, etc, yada, yada. 2 departments and too much time later, I've been told the account needs to be open for 30 days before Zelle will work.

Just in case anybody else wants to know...... because it wasn't anywhere on the Zelle or USAA websites

Tks WMH, Ive always used box 1, however i will begin using #3. I suppose one advantage is that if they paid rent and fees after filing, you could still get them out and irecoup filing fees. --99.203.xx.xxx
