Why do tenants wait for Sheriff to come for set out? Appears she is out. But when i ask she says "no" and once said she will wait for sheriff. Why not just leave keys as its apparent they have moved out. Is there some advantage? --99.203.xx.x |

Check your states abandoment laws. In AZ if no rent and unit vacant, except trash we can sieze possession in 5 days after notice. Ten days if possessions left. I'd need to reread it, I think it is if no communication from the T. Haven't done it in like ten years. --47.216.xx.xxx |

In my LL'ing career a few years back the sheriff called and asked if I had a crew and could do the set out a day ahead of his schedule. Of course I said yes.
Hid my work crew up the street and sheriff and I went to the door-- lady pulls back the kit curtain and just sees me and starts screaming profanities-- she didn't see the sheriff at the front door. When sheriff hears all this he pulls his gun as she flings open the door--- she says "I thought you were coming tomorrow" I'm not ready? He says "no were here today". She steps in front of the sheriff and he promptly takes her shoulder and says -- I've locked up one tenant today-- stand aside so you're not #2.
It was gratifying until the moment the kids were getting off the school bus while they saw the sheriff evicting them in front of their friends. I asked the women-- who would allow their kids to see this-- she and the sheriff said almost in unison-- done it before.

Usually when the sheriff hands or posts 7 day courtesy notice on door they leave the day before the sheriff arrives leaving only broken furniture, dirty clothes and garbage behind. Most areas the vacancy rate is declining so it is much more difficult to find a green housing provider who hands out keys with a handshake where most run a thorough credit check on all adult applicants. More often then not they take rental applications then never come back as they already know the results of a thorough credit check on all adult applicants. Unpaid utilities immediately disqualifies as unpaid bills and unpaid rent go hand in hand together. --147.194.xxx.xx |

To answer your question, some tenants are so lazy they would rather live on the street then to plan ahead for their next rental (roof over their head)!
Many times when evicting a tenant we enter into a stipulated agreement. If they move out within 30 days, they will owe NO BACK RENT and there will be NO EVICTION on their record.
Then 30 days later they are still in the rental. My eviction case was never dismissed. Now the court sends notice to the Sheriff for the lock-out. There goes another 7 to 10 days.
When the Sheriff shows up the now drive away with the final stuff in their vehicle thinking the are scott free....
But after the 30 days I get the police to pay a visit to my rental and document the unit is still occupied. And I get the utility company to confirm the power and gas was still on in the tenants name after the 30 day period.
SO my attorney can now go back to court and tack on the extra rent due and win a record-able judgment. --47.156.xx.xx |

JKJ MA I'll bet you have. Same with police and EMS. I'm trying to figure out why so many CARE more for others than their own family? It baffles me. I'm a total stranger to the tenants and see what this does to a kid-- the parents don't see it. WHY?

In all our years and 300+ evictions we've only had one who waited for the sheriff.
Indiana's eviction system gives the written notice to be out by a certain date. Most people comply.
If they are not out we get a second court hearing within 48 hours where the judge gives them another 24 hours to comply or be in contempt. Only had to do this a few times.
If still not out THEN the sheriff shows up for a lockout. No crews or moving required.

Had a tenant once take his life in one of my units. Apparently his divorce was too much for him to cope with.
Next of kin didn't want anything to do with him. His secondary emergency contact had passed on.
I filed for eviction. 40 days later on lock out date, the judge joked with me saying that I didn't need the Sheriff, I needed a priest. That said, if you don't use the Sheriff and all three parts the eviction process are not completed - and the eviction is contested.........you are setting yourself up for failure.
As for why any resident would wait for the day of lock out, you got me. I have had it happen a few times where they were given 10 minutes to gather up there stuff and then too coordinate with the manager to claim there items. --24.101.xxx.xx |

In the event you do not have forwarding address, you send to the last known address in the hopes that someone will have set mail forwarding address at the USPS.
This eviction was to set up the case that the personal property was then abandoned. I had the guys car sitting parked for over two months. along with a boat, and most of his personal items.
In the end, an estranged daughter stepped up and asked me for a small box of family photos and a wedding band. I agreed to ship what ever she wanted, provided she pay for the postage.
His person had lots of stuff - and still a security deposit and proceed from the sale of his items did not cover rent during the eviction and and packing and storing of items. Lesson learned for all - start the eviction process early on if for ANY REASON for non-payment --24.101.xxx.xx |
