Justice Department Sues California Landlord for Trading Sex for Rent Discounts

The seven-page complaint, filed in U.S. District Court in San Diego, accuses property owner Larry Nelson of entering the homes of his female tenants without reason and in several cases offering to reduce or forgive rent in exchange for sex, according to the Los Angeles Times.

In October 2017, the Department of Justice launched an initiative to combat sexual harassment in housing. In April 2018, the department announced the nationwide rollout of the initiative, including three major components: an outreach toolkit to leverage the department’s nationwide network of U.S. attorney’s offices, a public awareness campaign, including the release of a national public service announcement, and a new joint task force with HUD to combat sexual harassment in housing. Since launching the initiative, the Department of Justice has filed 10 lawsuits alleging a pattern or practice of sexual harassment in housing.

As a slight tangent to NE's comment , anti-discrimination laws do not go both ways. A store or LL or employer may not discriminate against customers, tenants or employees, respectively, based on protected class. But customers, tenants, and employees are free to choose their retailers, landlords, and employers for any reason, including race and gender. --144.250.xx.xx

That's right NE. I know what you mean. It is a major problem for us "lookers."

I remember viewing a TV judge show many years ago about a female tenant who made a deal with the LL to offer sex in exchange for no rent. This was a package deal that was supposed to happen for multiple times (maybe 10+).

LL held up his end of the deal. Tenant took him to court because she didn't think she should have to follow through with her end of what she thought would be considered an illegal deal (after only two or three friendly "visits").

Well, judge said that she did not fulfill her obligation and she was forced to repay for what she failed to perform on her end. --24.20.xxx.xxx

No, landlords shouldn't be doing whatever it is they are accused of. No, tenants should not be dumb/naïve/conniving/desperate/whatever to agree.

BUT, the federal government spending I'm assuming millions of dollars for a small problem that could be addressed elsewhere? ridiculous. --72.70.xxx.xx

These are real issues. But in most cases tenants who can't pay their rent make false claims against their landlord -- claiming some form of sexual harassment. Then when proven these claims were false, nothing is done to accuser. --47.156.xx.xx

JB, and even for guys who might not be ‘lookers, though you two might be at higher risk *grin*. I had one applicant ask if my husband would ever be picking up the rent. Huh? I had made NO mention of having a husband, though I do wear a gold wedding band. When I went to her house to pick up the application, I walked right by the stripper pole mounted six feet inside the front door. Said nothing about it. Denied for other stronger reasons, but the pole and asking if a man would be picking up rent. .. um No!

Depending on his approach on the subject, it might not be as much a case of harassment, as it is a case of discrimination because I'm assuming he only made this offer to females. To avoid discrimination, he would have needed to offer this proposal to both males and females, and any gender in-between. --108.69.xxx.xxx

The solution for accusations of sexual harassment by LLs is simple: ABR! Always Be Recording! Whenever I deal with female tenants now, I have a video cam or a voice recorder or a handyman witness and a provision in the rental agreement allowing me to record conversations "for quality control of services or complaints". There are so many fake harassment allegations like that against Justice Kavanaugh that protecting yourself is vital. --201.140.xxx.xx
