Is a signed paper document that is scanned to a pdf, using Docusign, and using a signing pad to sign a pdf all acceptable in courts these days as having an original signature on paper? (Printing the electronic version onto paper to bring to court, of course.) --67.164.xxx.xxx |

SECTION 7. LEGAL RECOGNITION OF ELECTRONIC RECORDS, ELECTRONIC SIGNATURES, AND ELECTRONIC CONTRACTS.
(A) A RECORD OR SIGNATURE MAY NOT BE DENIED LEGAL EFFECT OR ENFORCEABILITY SOLELY BECAUSE IT IS IN ELECTRONIC FORM.
(B) A CONTRACT MAY NOT BE DENIED LEGAL EFFECT OR ENFORCEABILITY SOLELY BECAUSE AN ELECTRONIC RECORD WAS USED IN ITS FORMATION.
(C) IF A LAW REQUIRES A RECORD TO BE IN WRITING, AN ELECTRONIC RECORD SATISFIES THE LAW.
(D) IF A LAW REQUIRES A SIGNATURE, AN ELECTRONIC SIGNATURE SATISFIES THE LAW.

Based on all my research and discussions with attorneys and others who should be in the know, electronic signatures are valid and can be used for just about everything except documents that will be filed such as deeds and mortgages. They still want wet signatures on those even though in many jurisdictions they can be electronically filed. --70.178.x.xx |

My wife is a realtor and uses Docusign for all agreements, until final losing with the title company, then, like razorback_tim[AR] says, "They still want wet signatures..." --47.28.x.xxx |
