Got an applicant here who was charged with driving without a license, no valid inspection and false ID to the police. The case was closed but says his bail was forfeited. I don't see the charges as that serious and technically, he was not convicted per se. What gives with the bail forfeiture? It looks like they just took the money and settled everything.

I've heard of that happening - they dismiss charges in exchange for forfeited bail - basically a fine without a conviction - or a bribe, however you prefer to view it. --70.178.x.xx

I have seen that,they set the bail at whatever they want to squeeze out of the defendant,then the defendant is happy to make the trade and the govt doesn't have to defend the arrest etc and it ends quickly --72.231.xxx.xxx

interesting. I'd guess that 75% of my tenants throughout the years have had "something" on their records and the past however many that we can see the records, I've never seen that.

So ... I am curious/nosey. Was there a preliminary hearing? an arraignment? pretrial conference scheduled? in other words, at what point in the process did this happen and what does the record actually say? nolle prossed? or does it say bail forfeited. dismissed? --72.70.xxx.xx

Nicole, as I look at this more closely, I think he forfeited bail for not showing up as there are also entries for bench warrants. I think the case is on going also. Here's what the tenant has to say:

"The charge is a misdemeanor for failure to produce proper driving receipts. I have 8 biological brothers one of them used my name and now it fell on my lap. I have 90 days to produce proof that it wasn't me or loose my license for a short time."

I think I'm going to approve him. First the charges aren't that serious and secondly, he's making 40K, has a decent job and wants a room. If he looses his license, then he'll be with me for awhile. Loss of the license is not making sense to me however. This started back in 2016. --209.122.xx.xxx

In some jurisdictions, this is simply how they set fines for traffic violations. You pay the "bail" amount and that resolves the matter. I think it might keep any "points" off of your license.

Among my various licenses I am a registered bail enforcement agent in AZ. LOL I was going to teach classes on it with a friend who is a "real" bounty hunter. Anyway I learned a little about the process.

As others have said there's several ways it can be forfeited. I'd just ask the applicant what was up. Obviously if you FTA it can be forfeited, though it can often be reinstated and extended if you clear up the FTA. Or it can be forfeited in lieu of a fine.

Any serious bail amount nowadays most bondsmen want a lien on real estate, and they won't chase you down either. If you don't show up they just foreclose and take your or your parents house. And some crooks have no honor and will let them do it. What happens then is the parents or whoever is about to lose their home will hire a bounty hunter through the bondsman (in AZ only a bondsman can hire a bail enforcement agent) and then the bounty hunter will hunt the person down.

-prosecuting atty fee to handle the case

-court filing fee
