I was informed by my sfr rental HOA they are charging a 'surplus' of $1,000/yr because it is not owner occupied. I promise you that my rental is one of the best kept houses in that subdivision. I am in Georgia (Cobb County) ...is this legal? Can someone recommend a knowledgeable, aggressive attorney? Thank You! --107.197.xx.xx

When I was working for clients as their contractor on their HOA rentals, the HOA president wanted to bully me around. Yes I can work, No I can't work. Yes I can park in the visitors spaces, no I can't. And so on.

The one disadvantage is that everyone was afraid of him. So I put in writing that I needed a guest parking spot when working in a clients unit. This was a non-carport spot and since I had a tall van, I needed the use. So the HOA president parked his vehicle in that spot.

If we sued the HOA president, the association would pay his legal fee's. So I decided it wasn't worth the trouble and the clients in that property had to hire help that the HOA approved of -- and got kick backs.

When my brother purchased a rental in that complex for an investment, the HOA treated him well. Then 2 years into his ownership they started to bark at him. I had installed a wash and dryer hookup in his private patio area. One of the few units with a large fenced in outside private yard. Since the president wanted a washer and dryer in one of his unit he allowed it.

But what I did was get a confirmation letter signed by the HOA staff and I pulled a City Plumbing Permit. Something the president never did himself. So when he ordered us to remove the wash and dryer from our rental patio area, I laughed in his face and reported him to building and safety for adding water, gas and electrical hookups outside without a permit. He was ordered by the City to remove the hook ups since the HOA voted that no one is allowed their own hook-up. We were grand fathered in.

This was a pain in the A_ _. That's why I never purchased more rentals belonging to an HOA..Or just didn't find the right deal. --47.156.xx.xx

read your bylaws, covenants, whatever legal documentation you were required to receive (and they were required to provide you) when you purchased the property. If you don't have it, ask NICELY and in a non-confrontational manner for copies.

Perhaps you agreed to this. Perhaps now, for whatever reason, including issues from other non-owner occupied units, not necessarily yours, they want to begin to enforce it. --72.70.xxx.xx

I hate HOA. after 20 yrs we are finally free. Please review your HOA docs to see if it listed in there. If not find out when this new rule went into effect and if it was legally voted in. Best to consult a lawyer familiar with HOA laws. I sued them a few times and won but what a way to live. --73.227.xxx.xxx

I'll echo Nicole (PA) - read the covenants and deed restrictions, by-laws. Focus especially on the language concerning rented/leased units, and also on how rule changes are to be effected. If a rule "change" was made arbitrarily and without proper procedures, it's not legal.

We have a sfh in an HOA which is very low-key. Like you, we keep the place nicer than most in the neighborhood.

A person who hates rentals for some reason bought in the neighborhood, and managed to get enough votes at the annual meeting to request that the membership be put to a vote as to whether or not to eliminate rentals.

Fortunately, the board couldn't get enough people in the HOA to sign off on a petition to formally change the rentals policy. Several pointed out my place as a reason why they did not object to rentals. (I would have been legally grandfathered in, anyway.)

The HOA docs can be modified, but that requires a majority HOA vote by the members to modify the laws and covenants. Find out if this change was voted by HOA members or just bullying from the board. --108.69.xxx.xxx

Get and read the the bylaws of your association. Most associations never update the bylaws from their original creation. And while the association is allowed to implement rules such as no bikes on sidewalks, money is a different subject. It does have to be passed at a annual meeting by a majority of owners but then it also must me incorporated into the bylaws requiring a lawyer and expense to the HOA so they rarely do that part. --73.144.xxx.xxx
