As promised, here are the laws recently passed in Colorado. Meeting was 2.5 hours long. Our group lawyer is actively involved with the legislature. Expect next year to be forced to accept Section 8.
HB19-1118 - Time period to cure - increased to 10 days. Effective now. No more partial payments or you have to start all over. Of note, substantial violations are still 3 days.
HB19-1106 - Rental Applications - mandatory receipts, criteria change. Effective August 2, 2019
HB19-1170 - Warranty of Habitability - big changes in time to cure, get a HEPA filter to deal with mold, pay for tenants hotel stay, they can withhold rent,etc. Effective August 2, 2019
HB19-1328 - Bed bugs - on the landlord now. Effective now. I hadn't even heard of this one.
SB 180 - Eviction legal defense fund - expect to be challenged if you do your own evictions. They are already seeing it in courts. Effective now.
HB19-1189 - Wage garnishment reform - effective now. Less likely you will be able to collect.
HB19-1309 - Mobile Home Park Act - The lawyer couldn't even get to this one. Looks to be a nightmare...glad I don't have a mobile home park.
Wow. It's gonna take me a while to process all of this. From my standpoint I can see costs going up for tenants. In 20+ years of landlording I never had to hire a lawyer for tenant issues. That may change.
A class on ESA's should be coming up in a few months. There was a $1 million lawsuit against the Meeker Housing Authority for this. Looks like they were idiots (government entity!) but unless HUD does something about this I need to be precise on my denials.
Going on a well deserved vacation tomorrow.

Looks like Oregon has set the new standard and the progressive Californians are hurrying to catch up. No matter which state they have taken over.

I've been doing this for many years, My application fee receipt is a full page long and includes that the applicant was given a copy of my written rental criteria before applying and that the rental application fee is non-refundable.
It lists all the things I may or may not do while screening.
At the bottom, I put a number for how many applicants are proceeding them.

We have mobile homes that will not pass Section 8 inspection ( they are not tied/anchored down) wonder if we'll be forced to do that?
I'm issuing what shuld be a 3 day cure today, but because of this new law I have to give 10 days, not happy

Thanks Oregon woodsmoke. I always offered a receipt for application. Most didn't take it. Now everybody will. Ugh, more paperwork. Written criteria will be available and they will sign for it.
C&J, not sure about mobile homes on private property. Laws are just a mess. Remember, if it is a substantial lease violation - violent/drug/substantial damage to others/public nuisance you can still use a three day notice.
I belong to a crime free housing program...all my tenants sign an addendum for this. Check Channel 7 in Denver website. They are talking about it. Available in in a few cities in Colorado. You may want to go to a class to get certified. Well worth your time. --74.121.xx.xxx |

Handymomma - thanks for this. I had a note in my calendar to look for your post ever since you promised it back in May! This is very helpful. Definitely will get worse for the tenants. Don't lawmakers understand this? Blocking the free market never works. To counter these laws, the following will begin until they are commonplace:
1. Have to be even more selective in tenant screening. Best way to avoid the 10-day eviction law is to keep out anybody who smells like an eviction.
2. Get a larger deposit.
3. Perhaps start collecting a move-in fee.
4. Raise rents to cover all the new costs. Do the lawmakers really think that we are just going to eat these costs?
I really appreciate your post, and can't wait for your summary of the ESA meeting!

Your list sounds similar to some laws proposed in Indiana. TOo similar. Is someone giving a seminar to legislators on how to drive up the cost of renting? Renters don't have eyes to check the home before signing?
My res says he's experimenting with weed smoke to eliminate bedbugs :) So they want YOU to take care of the bugs a res brings in?
Can you explain the one about application receipts?

The application bill is a doozy. You must state exactly what your actual costs are for running a credit/criminal check. They must be the same for everyone. You HAVE to give them a receipt...can be electronic. No more than 7 years rental/credit history, 5 years criminal. Denial must be in 20 days, I believe it can be electronic. They can sue for treble damages if you fail to follow the proper procedure. I'm still looking at all the stuff.

When I get back, I'm going to contact the Association Lawyer to find out how to get involved with the legislature.
