Quick question...long story short....long term tenant's brother moved in with his g/f and 3 kids in his 2 bedroom apartment. Tenant goofed..was trying to help him out...suppose to be temporary. Now brother and g/f won't leave. Total bums. We told him he cannot stay. Told him he had to get out. still there. Do we have to give them a 30 day notice to leave since they won't leave?? We have no problem with long term tenant. He wants his apartment back. He isn't even staying there right now b/c his brother won't leave. Just a big mess :(

Any suggestions. Only the long tern tenant is on the lease of course. It does state no one other then who is on the lease can stay. But since he's been there a couple months...what do we do. He needs to go!

Since you are unfamiliar with the procedure, please do yourself a favor and hire a good, experienced eviction attorney.

If you don't know who to hire, call your local district court to find out when evictions are heard.

Go to court and see who handles the evictions for others.

I rented a two bedroom unit to a nice family with two children. They had a third child soon after. No issues, nice family. A year later they allowed the wife's sister to move in with their two kids. Now I had 8 living in a two bedroom. This isn't the problem. The x-husband of the sister who moved in for a short stay is a pot smoking drunk. He would get high and pass out pot to some of my other tenants children, under 18 years of age.

I tried to work things out but they couldn't allow the drunk to sleep on the street so he'd sleep on the property, anywhere he found a spot.

My tenants were paying $775 a month for a two bedroom with two parking spots. The market rent was $1295. So I had no choice but to give the a Notice to Perform or Quit. Get the drunk off my property and thin out the heard, or else. (not my exact words).

So I had to proceed to the eviction.

Being kind to family cost them a roof over their head and $500 a month more in rent each month....Some family! --47.156.xx.xx

Now is the time to brush up on your local and state tenant laws, use them properly and you should have them out in about a month, you admit you are not real familiar so hire a flatfee eviction atty, traffic - murder - other criminal - real estate sales, do not understand housing court go there yourself for a couple months of observation and choose an atty who gets his cases in and out quickly - meet him in the hallway and get her/his card. --76.188.xxx.xx

I'm not sure I would get involved in that. I think Tim may be right. That's your tenant's problem. Sure, it's his brother, but why would that make it any different than if a stranger just refused to leave his place? Let him call the cops, magistrate, whoever. If I had to get involved, I'd remove all of them. If you got the brother out, he might just weasel back in at a later date and make you repeat the process.

The threat of total eviction may give the tenant some backbone to handle his own problems. He probably wants you to handle his problems so you can be the heavy. If that's the case, be heavy, really heavy. --108.69.xxx.xxx
