Just discovered that a tennant in my upstairs unit(owner occupied) has been shooting up drugs using a needle. Heard a lot of banging and thumping around last night and called the cops so that could handle it. He lives alone. Officers escort him out of the building and take him to the hospital. Officer and I walked into you and he show me syringe on the table that was used to shoot up.

Tennant arrives this morning and I asked him to explain him self to see if he would be honest about the situation. Tells me he relapsed due to PTSD. I informed he had to leave the premises by the end of the month. He complied.

My question is should this be an early termination due to extentuated circumstances or should I go through the courts to do the complete an eviction? --173.61.xxx.xxx

He informed him that he had to go. He says he'll start looking for a place. His kid's mother is going to be working with him to get her things as well. So it's might assumption that he will be out by the end of the month. My question is, is there anything I need to do on my part legally to ensure that things go with out it coming back on me regarding deposits, etc? --173.61.xxx.xxx

I had similar situation but they couldn't find another place so they kept hanging around and not paying of course.

Jay I did have a few questions because I think your story is very suspicious. You called the cops cause someone was making noise? They took him to hospital-- NOT JAIL.... is that right? You then went into his place when he wasn't there and planted a suringe on the table fo rthe cops to find--- so you could evict tenant and get more rent and steal his drugs? -- for what reason? That's called B&E. He now has to leave? WHY? You saw him do this? Something isn't right here. When a tenant is impaired from the use of drugs or alcohol they are a danger to everyone including themselves. I do not tolerate this kind of behavior. I've seen tenants that were impaired set fire to the property, fall down stairs, attack a friend and worse.

You already gave him until the end of the month, so he has until the end of the month. Write up a notice to give to him so it is in writing.

Get him to sign the notice that you and he mutually agree to end the lease by June 30.

You said you already contacted his mother and she is helping with the move, so hope that he will be out by his last date.

I'd handle the deposit in the normal way. You are the one who is terminating the lease, not him. Whatever damage and clean-up you need to do, deduct from his deposit. He gets the balance back. --98.146.xxx.xxx

I sorta agree with MYOB, they slammed on the brakes and took a HARD RIGHT though, I am only slowing the train down a little. Jay, why did you enter your tenants unit? I mean I agree that you should get rid of him, but you can’t just go into your tenants unit because he went to the hospital. If I were you on the eviction forms don’t say you walked in the unit after he left in an ambulance and found a syringe!! Maybe just say that the police told you there was a syringe on the table, and you asked him about it when he returned the next morning, that’s when he admitted using intravenous drugs. --71.248.xxx.xxx

Sounds like he's leaving without creating an incident so whatever happened, the tenant knows he did something bad enough to get him in trouble.

Since he's leaving, I'd be lenient about fees and stuff. If you need to entice him towards the end and he is a junkie, drug money for keys could be quite motivating. --108.69.xxx.xxx

I agree that you need to tread carefully here. Junkie or not, tenants have rights. You can CYA about being inside property- when police took one of my tenants to the hospital they called me and told me to go to the property and secure it.
