My property is in PA. I have a new tenant of two months. Last week she called me in a panic that her furniture she put outside for bulk trash to pick up was gone only to find that "whoever" took it put their roach infested couch there instead. Now she claims there are roaches in her apartment. I have had this house (duplex complex) for over 10 years and I have NEVER had a problem with roaches nor other insects. As the landlord, am I financially responsible for the exterminator? If so, how can I in the future make the tenant financially responsible for any subsequent exterminator services? Is it too late to amend her lease to include this provision? --174.200.x.xxx |

So the lady is getting rid of her couch at the curb? Then someone doesn't take it, but actually SWAPS it for another couch? And no she has roaches because of this?

In most jurisdictions a Landlord is responsible to deal with any pests, bugs, insects or critters. Once the problem has been eradicated, then if the landlord can "prove" it was the tenants fault, the landlord can try to collect back their costs.

I had a similar situation with my drunk pig tenants. They found a discarded couch, brought it into the rental, and a huge pack of roaches ran out. I spread a little Maxforce around as a courtesy and never heard another word. I told the tenants next time they pulled that trick, the exterminator bill was on them. Here you can hold a single family responsible but not a multifamily like a duplex. One of the drawbacks.
Unless she admits to bringing the roach infested couch into her unit I would say you cant get out of this.

Slow down this train for a moment, she put her old discarded couch outside for bulk trash pickup, someone took her couch, but left another discarded couch, but this 1 is infested with cockroaches and now they are in her apartment??? That’s ridiculous, she had roaches and tossed her own infested couch and now made up this story to get out of paying an exterminator, but unfortunately I think your on the hook for it. The tenant claims someone replaced her old couch on the curb and swapped it out for a roach infested one (the "roach" couch is gone. What a coincidence!). Now she's implying the roaches crawled from the curb to her first floor duplex apartment (approximately 20ft). The upstairs apartment is vacant undergoing renovation. I understand now I will have to fumigate the entire house! In the future, how should I word the tenants'leasing so that they are responsible for exterminator services? in Pennsylvania, in a multiunit building, it will always be your responsibility. I personally don't treat for bugs while the offending tenant is still there ... I will treat the other units and once the buggy tenant is gone I do the entire place.
Knock on wood ... I haven't had bed bugs or roaches for several years.
For many, many years, multi units were my choice of rentals due to cash flow. After a few bouts of bed bugs and the tremendous sums of money it cost me, I have been transitioning to small single family houses ... one of the top (but not the only) reasons being pest treatment. --72.70.xxx.xx |
