Had another one for the rooming house today. Sounded real good on the phone. This is a 63 year old female on disability and with a PT job. Checked her on PA Courts and she's got an active case with charges for simple assault, aggravated assault and harassment. The aggravated assault charge appear to involve a gun. She had to spend a day in jail and bail was set at 30,000. To me that bail level indicates the seriousness of the charges. HUD takes a dim view of denying people who have simply been charged and not convicted. Rather than straight up decline her, I told her to get back to me after final disposition of the charges. Obviously, that doesn't help her now. She has a clean record otherwise. She's responded as follows:

"There not even true. Abusive controlling boyfriend trying to steal house from me. Didn't even have formal charges yet. But ok. Innocent before proven guilty is the law"

She's right and this lines up with HUD's thoughts on this as well. As she has no other criminal history, she'll probably wind up in ARD. How would you handle?

Do you have a policy about guns in the rooming house? Innocent until proven guilty but similar to no pets policy when they say they will get rid of their new puppy and we would deny, perhaps a no gun policy in the rooming house might work here. --24.61.xxx.xx

My thoughts for what their worth, if she was found guilty you wouldn’t accept her correct? You wouldn’t accept her because you don’t want that kind of tenant in your rooming house for the safety of the other tenants in addition to the fact you don’t want drama. Don’t deny her, postpone your decision pending the outcome of the charges. What if she’s lying? Innocent until proven guilty doesn’t apply to LL screening, (in my opinion). If I screened a tenant that was charged with a serious crime I wouldn’t just assume their innocence until found guilty, the opposite actually, I’m going to assume their guilty until proven innocent. --71.248.xxx.xxx

I have to deal with this sometimes, too. I think your approach is good. Postponed pending the outcome, not "denied". Not sure how a judge would view it-it's really the same as denied for all practical purposes, and I wouldn't want to be the test case, but what else do we have?

I routinely do credit checks for roomer applicants, to verify info on app & get any missing addresses/info they conveniently forgot to include. So I may find something there to DQ - as NE suggests. But maybe not, since the requirements for a roomer do not include good credit.

If you don't normally pull credit, or hold those things against a roomer applicant, then you're in trouble if you do it here.

Here, we also cannot deny someone their legal right to own a gun.

It's like walking on hot coals. Perhaps at least adding something about this situation to the written criteria is a good idea, but mostly just hope nobody tries to get a lawyer to prove their "rights" to be in your (my/our) place.

I Hope she goes away and doesn't make it an issue!

DJ, so you can’t deny if they legally own a gun and many wouldn’t say but I didn’t know if a rooming house would be different because of the shared living space. I wondered about people leaving their doors unlocked while cooking, showering and didn’t know if that was a potential issue with someone entering a room and taking it or if tempers flared more in rooming houses. Do you have different lease clause restrictions for the rooming house vs apartment?

Just because she has been charged with a crime,...you want to assume she is guilty. Maybe she is but then again, maybe she is just a victim of circumstance.

Here's the thing Roy, I looked up the section of the law that her aggravated assault charge falls under and a gun was involved and that accounts for the high bail. Although she otherwise has a clean background, that sort of temper in a close setting like a rooming house can be problematic. My rules prohibit weapons, but I can't really police that. --209.122.xx.xxx

I would not rent to her in a boarding house situation. Set aside her ability to afford: SFR - yes, Apartment - maybe, Boarding house - NO.

Reason is that she and her boyfriend will interact with your other residents, and she or her choices of boyfriend do not interact well with others and could create a mass exodus from your rooming house. --72.172.xxx.xx

Roy, What does the fact that she’s 63 and had a clean record before this incident have to do with anything? People in their 60’s with clean records get charged and convicted of serious crimes all the time. The BTK killer had a clean record before he was convicted of killing and torturing all those women. She was charged with a fairly serious crime that involved a gun, she claims she was wrongly charged and that her “abusive boyfriend was stealing her house” What’s that even mean, instead of explaining like a rational adult she says “so much for innocent until proven guilty”! --174.199.xx.xxx

I'd bet if you look up a PFA, there has been one filed. Here, they charge you with harassment & simple assault along with the PFA. If it's the first time, I believe they nolle pros the simple assault (a misdemeanor) and make you pay the harassment fine (summary) --72.70.xxx.xx

Perhaps innocent, however from a liability perspective that you could also be facing if another mishap occurs of a violent nature.....the judge will be asking you - Did you know of or should have know of a history of violence.

Nope. Not buying it. They don't get to have it both ways. If she was your tenant , you would not be able to evict her for being charged with a crime.... even if it was drug dealing out of your property. You would have to wait for a conviction. It's not as much about being innocent as it is being a liability. I don't know a lot of stable people who have been accused of the charges you mention. --71.10.xxx.xxx
