Have a tenant who emailed me that their neighbor (a brand new tenant,) had locked themselves INside their unit so, he gallantly went and kicked the units door in, to free her. The result, door smashed, and damage to the jam...Who should get the bill? or do we eat the bill? Also, there were no known prior issues or any recently reported issues with the door handle or lock prior to this indecent. And oddly the tenant with the smashed door isn't the one contacting me for it's repair, it's the one who kicked the door in who's asking for the repair. --73.144.xxx.xx |

Our lease specifies that the tenant is responsible for any damage caused to their unit, regardless of who causes it, and regardless of the reason, except for acts of God. We made this change about a decade ago because it is rare that someone confesses to causing damage themselves: they always blame it on someone else. The neighbor kid, a burglar, etc.
I don't care who did it. Tenant pays. If they know who did it, then they can seek restitution from that person. Otherwise, they can file for reimbursement with their renter's insurance company, if they were smart enough to follow our recommendation to purchase it.
We contract the repair and pay for it, then submit the bill to the tenant. Our lease also specifies that any money received is applied to damages and fees first and rent last, so if they "refuse" to pay they end up short on the rent. Then we evict for non-payment of rent.

In most locations, Fire Code requires 2 exit doors. Was this the only door or were they both so caught up in the moment that no one thought about the 2nd exit?

I was pretty confident that the direction to go with this was billing the tenant, that is if the tenant reports the damage and isn't planning on doing the repair themselves. I just wanted to hear other opinions, and no there were no issue w/ the door or door handle that we were aware of and given the unit just went thru a turn over two weeks ago, it would have been caught if there was a problem. The door handle isn't brand new, but we did just have it re-keyed. The unit is in an older home, built in 1895 doors are very thick solid doors, and original to the home, never had problem with the door sticking. As for why the tenant has not contacted me, I cannot say, but I have been told the door still functions, and does still lock w/ the deadbolt, so could be she's going to seek repair herself, not exactly sure. I'm a landlord and contractor. One client gave their adult daughter a two bedroom unit in an apartment building, making her the manager too. She was going to college and allowed a friend to stay with her. Her friend was separated from her abusive husband.
I came to the property to do some work and saw the daughters car in her parking spot. I heard fighting, screaming and glass breaking inside of her unit. The abusive husband found out where his wife was and the girls let him inside to avoid a commotion. Instead they were getting beat up.
Here in Los Angeles it takes around 3 to 5 minutes to connect to 911 from a cell phone and around 20 minutes to hours for the police to show up. I tried my master key but the daughter changed her lock. So I KICK In the front door and removed the abusive husband from the unit. The police showed up and took him to jail. The wife and manager refused to press charges, I had no problem filing charges myself.
As a net result in saving the owners daughter and her friend from getting beat up -- they made me replace the door, frame, locks and paint it to match the old paint -- at my expense. No gratitude.

It is always to have a passage lock then a dead bolt so a key must used to lock the door. I would charge the tenant as a lock smith or lock could have drilled out instead of breaking down the door. If you replace the door without charging the tenant then future damage is going to continue. With a deadbolt and passage lock there is absolutely no need to break down the door. --147.194.xxx.xx |
